FixFlowIQ’s New Updated Terms of Service 8/23/26
For purposes of these Terms of Service ("Terms"), the following definitions apply:
Refers to FixFlowIQ LLC, a North Carolina limited liability company, including its affiliates, successors, assigns, employees, officers, directors, representatives, licensors, contractors, and authorized agents.
Refers to the FixFlowIQ website, mobile applications, software, marketplace, communication tools, artificial intelligence features, provider matching systems, databases, APIs, content, and all related services offered by FixFlowIQ.
Refers to any individual or entity that accesses, browses, registers for, or otherwise uses the Platform, including Customers, Providers, visitors, and account holders.
Refers to any User who submits a vehicle repair request, requests roadside assistance, requests towing services, seeks automotive-related services, communicates with Providers, receives Quotes, schedules appointments, or otherwise uses the Platform to obtain automotive services.
Refers to an independent automotive service business or individual approved by FixFlowIQ to offer services through the Platform, including but not limited to:
Automotive repair shops
Mobile mechanics
Diesel mechanics
Body repair shops
Tire shops
Window tint shops
Towing companies
Roadside assistance providers
Specialty automotive service providers
Other approved automotive-related businesses
Providers are independent businesses and are not employees, agents, representatives, partners, joint venturers, franchisees, or contractors of FixFlowIQ.
Refers to automotive-related services offered by Providers through the Platform, including but not limited to diagnostics, inspections, maintenance, repairs, roadside assistance, towing, installations, body work, tire services, window tinting, detailing, specialty automotive services, and any other services offered by approved Providers.
Refers to information submitted by a Customer describing a vehicle issue or requested automotive service, including vehicle information, service description, photographs, location, preferred appointment times, and any supporting documentation.
Refers to an estimate, proposal, price, timeline, recommendation, or service offer submitted by a Provider in response to a Customer's Repair Request.
Quotes are created solely by Providers. FixFlowIQ does not determine, modify, verify, negotiate, or guarantee pricing, labor costs, parts costs, repair methods, completion times, availability, or the accuracy or completeness of any Quote.
Refers to the scheduling of an appointment or acceptance of a Provider's Quote through the Platform after a Customer selects a Provider and completes any required booking steps, including payment of any applicable Booking Fee.
Refers to a non-refundable platform service fee charged by FixFlowIQ to facilitate a confirmed Booking between a Customer and a Provider. Unless otherwise stated, the Booking Fee is separate from the Provider's charges for labor, parts, taxes, fees, or other repair-related costs.
Refers to a Provider that has entered into a separate agreement with FixFlowIQ to participate in the Preferred Partner Program and may offer exclusive discounts, promotions, priority service, or other benefits to eligible FixFlowIQ Customers.
Participation in the Preferred Partner Program does not create an employment, agency, franchise, partnership, joint venture, or other similar relationship with FixFlowIQ.
Refers to a Provider that has completed FixFlowIQ's approval and verification process. Verification may include review of business information, licenses, insurance documentation, certifications, service offerings, identity information, business history, or other information determined by FixFlowIQ.
Verification indicates only that the Provider satisfied FixFlowIQ's review requirements at the time of approval. It is not a certification, endorsement, warranty, guarantee of quality, guarantee of future performance, or representation that the Provider will always perform services safely, professionally, accurately, or in compliance with applicable laws.
Refers to the customer service and business standards established by FixFlowIQ that participating Providers agree to uphold as part of the approval process. These standards are intended to promote professionalism, transparency, accountability, and customer satisfaction but do not constitute warranties or guarantees by FixFlowIQ.
Refers to a Provider that represents through the Platform that it offers a written or stated warranty applicable to certain Services, repairs, labor, parts, or workmanship and that has been approved by FixFlowIQ to display the Warranty-Backed Provider designation or badge.
The Warranty-Backed Provider designation indicates that the applicable Provider has represented that it offers warranty coverage under its own stated terms and conditions. The designation does not mean that FixFlowIQ provides, issues, underwrites, administers, funds, insures, guarantees, or is otherwise responsible for the Provider's warranty.
Refers to any warranty, workmanship guarantee, parts warranty, labor warranty, service guarantee, or similar commitment independently offered by a Provider to a Customer in connection with Services performed by that Provider.
Provider Warranties are established, issued, administered, and fulfilled solely by the applicable Provider unless expressly stated otherwise in writing by FixFlowIQ. The scope, duration, mileage limitations, eligibility requirements, exclusions, claim procedures, remedies, transferability, and other terms of a Provider Warranty are determined by the Provider and may vary between Providers and Services.
Refers to any badge, icon, designation, label, profile indicator, or other visual identifier displayed through the Platform indicating that a Provider is identified as a Warranty-Backed Provider.
A Warranty Badge is provided for informational and marketplace identification purposes only and does not constitute a warranty, insurance policy, guarantee, certification of repair quality, or promise by FixFlowIQ that the Provider will honor any warranty claim.
Refers to information relating to a Provider Warranty that may be displayed, submitted, stored, or communicated through the Platform, including warranty duration, mileage limitations, covered Services, covered parts or labor, exclusions, eligibility requirements, claim procedures, supporting documents, and other warranty-related terms.
Customers are responsible for reviewing the applicable Provider's Warranty Information before authorizing Services and for requesting clarification directly from the Provider when warranty terms are unclear.
Refers to all text, graphics, logos, photographs, videos, software, code, designs, trademarks, service marks, databases, ratings, reviews, comments, messages, documents, files, and other materials made available on or through the Platform.
Refers to any information, documents, photographs, videos, reviews, ratings, messages, comments, Repair Requests, communications, warranty-related information, service records, invoices, or other materials submitted, uploaded, transmitted, or otherwise provided by a User through the Platform.
Refers to artificial intelligence, machine learning, automated routing, recommendation systems, matching algorithms, ranking systems, filtering tools, predictive technologies, or other automated decision-support technologies used by FixFlowIQ to assist in operating the Platform.
AI Features are intended to improve marketplace efficiency and user experience. They do not replace human judgment and do not guarantee that any Provider, Quote, recommendation, repair outcome, warranty determination, or match is the best, most accurate, safest, or most appropriate for a particular Customer or situation.
Refers to the online technology platform operated by FixFlowIQ that enables Customers and independent Providers to discover one another, exchange information, communicate, submit Repair Requests, receive Quotes, review Provider information, view Provider Warranty Information, schedule Services, and complete Bookings.
FixFlowIQ acts solely as a technology marketplace and does not itself provide automotive repair, towing, roadside assistance, maintenance, inspections, diagnostics, warranty repair services, or other automotive services unless expressly stated otherwise.
Refers to all applicable federal, state, local, and international laws, regulations, ordinances, codes, licensing requirements, court orders, and governmental rules that apply to a User's activities on or through the Platform.
Refers to any day other than a Saturday, Sunday, or federal holiday observed in the United States.
Refers to these Terms of Service, together with any additional policies, guidelines, standards, notices, or legal agreements incorporated by reference, including the Privacy Policy and any other policies published by FixFlowIQ.

Welcome to FixFlowIQ.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Customer," or "Provider") and FixFlowIQ LLC ("FixFlowIQ," "Company," "we," "our," or "us") governing your access to and use of the FixFlowIQ Platform, including our website, mobile applications, software, marketplace, communication tools, artificial intelligence features, provider matching systems, and all related products and services (collectively, the "Platform").
By accessing, browsing, registering for, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms, you must immediately discontinue use of the Platform.
To use the Platform, you represent and warrant that:
You are at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater.
You have the legal authority and capacity to enter into binding contracts.
Any information you provide to FixFlowIQ is accurate, complete, and current.
You will comply with these Terms and all applicable federal, state, and local laws.
Your use of the Platform has not previously been suspended or terminated by FixFlowIQ, unless expressly authorized by us in writing.
If you are accessing or using the Platform on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, the terms "you" and "your" refer to both the individual acting on behalf of the entity and the entity itself.
Your continued access to or use of the Platform after any updates to these Terms constitutes your acceptance of the revised Terms.
If you do not agree to any revised Terms, you must stop using the Platform and, if applicable, close your account.
Your use of the Platform may also be governed by additional policies, guidelines, standards, or agreements published by FixFlowIQ from time to time, including but not limited to:

Preferred Partner Agreements
Community Guidelines
Payment Policies
Booking Policies
Cancellation Policies
Promotional Terms

Other policies or legal notices made available through the Platform
These documents are incorporated into these Terms by reference where applicable.
You acknowledge and agree that clicking buttons such as "Create Account," "Register," "Sign Up," "Continue," "Submit," "Book Now," "Accept," "I Agree," or any similar electronic confirmation constitutes your electronic signature and has the same legal force and effect as a handwritten signature under applicable law.
You further agree that electronic records, electronic communications, and electronically executed agreements satisfy any legal requirement that such communications or agreements be in writing.
FixFlowIQ reserves the right, in its sole discretion and to the fullest extent permitted by law, to refuse access to the Platform, deny registration, suspend or terminate accounts, remove content, reject Provider applications, or restrict access to certain features at any time, with or without notice, for any lawful reason, including violations of these Terms or conduct that may harm the Platform, its Users, or the public.
You are solely responsible for ensuring that your access to and use of the Platform complies with all applicable laws, regulations, licensing requirements, court orders, and governmental rules in the jurisdiction where you access or use the Platform.
FixFlowIQ makes no representation that the Platform or its services are appropriate, lawful, or available in every jurisdiction.
These Terms, together with the Privacy Policy and any additional agreements or policies expressly incorporated by reference, constitute the entire agreement between you and FixFlowIQ regarding your use of the Platform and supersede all prior or contemporaneous understandings, communications, representations, or agreements relating to the subject matter of these Terms.
No oral statements, representations, or course of dealing shall modify these Terms unless expressly agreed to in writing by an authorized representative of FixFlowIQ.
FixFlowIQ is an online technology marketplace that connects vehicle owners with independent automotive service providers. The Platform enables Customers to submit vehicle repair requests, receive Quotes, communicate with Providers, compare available service options, review Provider information, view available Provider Warranty Information, schedule appointments, and access automotive-related information.
FixFlowIQ provides the technology and tools that facilitate these interactions but does not itself perform, supervise, manage, control, or guarantee the automotive services offered by independent Providers.
FixFlowIQ is not:
An automotive repair shop
A mobile mechanic
A diesel mechanic
A body repair facility
A tire shop
A towing company
A roadside assistance provider
A window tint company
An automotive parts supplier
An insurance company
A warranty provider or warrantor
A warranty administrator or underwriter
A vehicle inspection company
A dealership
A transportation company
A vehicle storage facility
A licensed automotive contractor
An employer of Providers
FixFlowIQ does not repair, diagnose, inspect, maintain, tow, transport, or service vehicles.
Unless expressly stated otherwise in a separate written agreement issued by FixFlowIQ, FixFlowIQ does not issue, underwrite, insure, administer, fund, fulfill, or guarantee warranties offered by independent Providers.
All automotive services available through the Platform are offered and performed solely by independent Providers.
Each Provider operates as an independent business and is solely responsible for:
Business operations
Licensing and permits
Insurance coverage
Professional qualifications
Certifications
Employee management
Pricing
Estimates and Quotes
Repair recommendations
Workmanship
Parts selection
Warranties offered by the Provider
Warranty terms, limitations, exclusions, and claim procedures
Determining whether a warranty claim is covered
Performing any warranty-related rework, replacement, refund, or other remedy required under the Provider's warranty
Compliance with applicable laws and regulations
Customer communications regarding the services they provide
Collection of payment for automotive services, except for any platform fees collected by FixFlowIQ
Nothing in these Terms shall be interpreted as creating an employment, agency, franchise, partnership, joint venture, fiduciary, or contractor relationship between FixFlowIQ and any Provider.
Although FixFlowIQ may establish marketplace standards, approval requirements, participation guidelines, badge eligibility requirements, or other Platform policies, FixFlowIQ does not control or direct how a Provider performs automotive services.
FixFlowIQ does not supervise repairs, determine repair methods, specify tools or equipment, require particular parts, direct employees of a Provider, establish labor rates, or otherwise manage the day-to-day operations of any Provider.
Each Provider independently determines how to perform the services it offers and remains responsible for the quality, legality, safety, and outcome of those services.
Quotes, repair recommendations, diagnoses, labor estimates, parts recommendations, repair timelines, and pricing are prepared solely by the Provider.
FixFlowIQ does not:
Create or negotiate Quotes
Determine labor rates
Approve repair recommendations
Verify repair diagnoses
Guarantee repair pricing
Guarantee repair completion times
Recommend one Provider over another solely by virtue of Platform participation
Participate in negotiations between Customers and Providers
Customers are solely responsible for reviewing Quotes, asking questions, comparing available options, reviewing applicable warranty terms, and deciding whether to proceed with any recommended service.
FixFlowIQ may review business information, licenses, insurance documentation, certifications, photographs, service offerings, business history, or other information during the Provider application process.
Approval as a Provider or designation as a Verified Provider means only that the Provider satisfied FixFlowIQ's approval requirements at the time of review.
Verification does not constitute:
A certification
A professional endorsement
A guarantee of workmanship
A guarantee of future performance
A warranty of services
A guarantee that a Provider will honor every representation or warranty
A representation that a Provider will always comply with applicable laws
A promise that every Customer experience will be satisfactory
Customers should exercise their own independent judgment before selecting a Provider.
Some Providers may participate in the FixFlowIQ Preferred Partner Program and may offer discounts, promotions, priority service, or other incentives to Customers.
Participation in the Preferred Partner Program does not constitute an endorsement or recommendation by FixFlowIQ and does not create any employment, agency, franchise, partnership, or joint venture relationship between FixFlowIQ and the participating Provider.
Unless expressly stated otherwise, FixFlowIQ does not guarantee the availability, amount, duration, eligibility requirements, or applicability of any discount or promotional offer made by a Provider.
Certain Providers may be identified on the Platform as Warranty-Backed Providers and may display a Warranty Badge or other designation indicating that the Provider represents that it offers a warranty applicable to certain Services, repairs, labor, parts, or workmanship.
The Warranty-Backed Provider designation and Warranty Badge are intended to help Customers identify Providers that represent that they offer warranty coverage. They do not mean that FixFlowIQ provides or guarantees that warranty.
Any Provider Warranty is offered solely by the applicable Provider and is subject to the Provider's own terms, conditions, limitations, exclusions, eligibility requirements, mileage limits, time limits, claim procedures, and available remedies.
Unless FixFlowIQ expressly agrees otherwise in writing, FixFlowIQ:
Is not the warrantor
Does not issue or underwrite the Provider Warranty
Does not insure the Provider Warranty
Does not fund warranty repairs or claims
Does not administer or adjudicate warranty claims
Does not determine whether a repair qualifies for warranty coverage
Does not guarantee that a Provider will approve or honor a warranty claim
Does not guarantee the accuracy, completeness, or continued availability of any Provider Warranty
Is not responsible for the performance, denial, fulfillment, or breach of a Provider Warranty
Customers are responsible for reviewing the applicable Warranty Information before authorizing Services and should obtain clarification directly from the Provider regarding any warranty terms that are unclear.
FixFlowIQ may allow eligible Providers to display a Warranty Badge, warranty duration, mileage limit, coverage description, or other Warranty Information on the Platform.
FixFlowIQ may establish eligibility requirements for displaying a Warranty Badge and may remove, suspend, modify, or revoke a Provider's Warranty-Backed Provider designation if FixFlowIQ reasonably believes that:
The Provider's Warranty Information is inaccurate, outdated, incomplete, or misleading
The Provider no longer offers the represented warranty
The Provider repeatedly fails to honor valid warranty commitments
The Provider violates these Terms or applicable Platform policies
Continued display of the Warranty Badge could mislead Customers or harm the integrity of the Marketplace
Removal or suspension of a Warranty Badge does not make FixFlowIQ responsible for any existing warranty obligation owed by the Provider to a Customer.
The Platform may use artificial intelligence, machine learning, automated routing, recommendation systems, filters, ranking algorithms, or other automated technologies to assist in matching Repair Requests with Providers, organizing search results, or improving Marketplace functionality.
These technologies are designed solely to improve efficiency and user experience.
Automated matching does not constitute a recommendation, certification, endorsement, guarantee, or professional opinion regarding any Provider, warranty, or repair solution.
FixFlowIQ does not guarantee that automated systems will identify every available Provider or that any suggested match is the most qualified, closest, lowest priced, fastest, or best option for a Customer's specific needs.
The Platform may allow Customers and Providers to communicate before, during, or after a Booking, including communications concerning Quotes, repairs, appointments, warranties, warranty claims, complaints, or follow-up service.
FixFlowIQ is not a party to these communications and is not responsible for statements, representations, promises, negotiations, agreements, warranty determinations, or disputes between Users unless expressly required by applicable law.
Information provided through the Platform, including educational materials, maintenance reminders, AI-generated content, articles, blogs, FAQs, notifications, repair information, warranty information supplied by Providers, or customer support communications, is provided for general informational purposes only.
Such information is not intended to replace the advice, diagnosis, inspection, warranty interpretation, or recommendations of a qualified automotive professional or the applicable Provider.
Users should exercise independent judgment and consult an appropriately qualified professional regarding the condition, safety, operation, repair, or warranty coverage of their vehicle.
Customers are solely responsible for evaluating Providers, reviewing Quotes, verifying pricing, asking questions, authorizing repairs, reviewing Provider Warranty Information, understanding applicable warranty limitations and exclusions, retaining relevant service documentation, inspecting completed work, and determining whether a Provider is appropriate for their individual needs.
The decision to hire, schedule, authorize, or pay a Provider is made solely between the Customer and the selected Provider.
Except as expressly stated in these Terms, FixFlowIQ's role is limited to operating and maintaining the technology Marketplace that facilitates connections between Customers and independent Providers.
FixFlowIQ is not a party to the agreement for automotive services or any Provider Warranty between a Customer and a Provider and is not responsible for the performance, quality, legality, safety, timeliness, pricing, completion, warranty coverage, warranty claim determination, or outcome of services provided by any independent Provider.
To access or use the Platform, you must:
Be at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is greater.
Have the legal capacity to enter into a binding contract.
Comply with these Terms and all applicable laws.
Provide accurate, complete, and current registration information.
Not be prohibited from using the Platform under any applicable law or prior suspension by FixFlowIQ.
By creating an account or using the Platform, you represent and warrant that you satisfy these eligibility requirements.
Certain features of the Platform require you to create an account.
When registering, you agree to:
Provide truthful, accurate, complete, and current information.
Maintain and promptly update your account information if it changes.
Use your own legal name or authorized business name.
Register only one account unless FixFlowIQ expressly authorizes additional accounts.
Keep your contact information current so that we may communicate important notices regarding your account or use of the Platform.
FixFlowIQ reserves the right to reject any registration request or require additional information to verify an account.
You are solely responsible for maintaining the confidentiality of your account credentials, including your username, password, verification codes, and any other login information.
You agree to:
Keep your login credentials secure.
Not share your account with another person or business unless expressly permitted by FixFlowIQ.
Notify FixFlowIQ immediately if you believe your account has been accessed without authorization or your credentials have been compromised.
Log out of your account when using shared or public devices.
You are responsible for all activity that occurs under your account unless otherwise required by applicable law.
You agree that all information you provide to FixFlowIQ, including your name, contact information, vehicle information, business information, payment details, licensing information, insurance documentation, certifications, photographs, and any other submitted materials, will be truthful, accurate, and not misleading.
You agree not to impersonate another person or business or misrepresent your identity, qualifications, ownership, or authority.
FixFlowIQ may, but is not obligated to, verify the identity of Users through documents, third-party verification services, confirmation emails, telephone verification, business records, government-issued identification, or other verification methods.
Failure to complete requested verification may result in delayed access, restricted functionality, suspension, denial of registration, or termination of your account.
Verification by FixFlowIQ does not constitute a guarantee of a User's identity, honesty, qualifications, or future conduct.
If you register on behalf of a business, you represent and warrant that:
You are authorized to act on behalf of the business.
The business information provided is accurate and complete.
You have authority to bind the business to these Terms.
All individuals using the account are authorized representatives of the business.
The business is responsible for all actions taken through its account.
Customers are responsible for ensuring that vehicle information, service requests, photographs, appointment details, locations, and communications submitted through the Platform are accurate to the best of their knowledge.
Customers understand that inaccurate or incomplete information may affect the accuracy of Quotes, scheduling, repair recommendations, or Provider availability.
Providers may be required to submit additional information before receiving approval to use the Platform.
Such information may include:
Business licenses
Insurance documentation
Certifications
Business addresses
Service areas
Business photographs
Contact information
Tax information
Banking or payment information
Other documentation reasonably requested by FixFlowIQ
Submission of an application does not guarantee approval.
FixFlowIQ reserves the right to approve, deny, suspend, revoke, or reconsider Provider applications at its sole discretion, subject to applicable law.
Unless expressly authorized by FixFlowIQ, Users may not create multiple accounts for the purpose of:
Circumventing suspensions or restrictions.
Manipulating reviews or ratings.
Submitting duplicate Repair Requests.
Obtaining promotional incentives multiple times.
Misrepresenting business identity.
Interfering with marketplace operations.
FixFlowIQ may merge, suspend, or remove duplicate or unauthorized accounts.
FixFlowIQ reserves the right to suspend, restrict, or terminate any account, temporarily or permanently, with or without prior notice, if we reasonably believe that a User has:
Violated these Terms.
Violated applicable law.
Submitted false or misleading information.
Engaged in fraudulent, deceptive, abusive, or unlawful conduct.
Interfered with the operation or security of the Platform.
Misused the messaging system.
Attempted to circumvent booking fees or Platform policies.
Misrepresented qualifications or business credentials.
Threatened the safety or rights of other Users.
Otherwise engaged in conduct that may harm the Platform, its Users, or FixFlowIQ.
Nothing in this section limits any other rights or remedies available to FixFlowIQ under these Terms or applicable law.
You may request deletion of your account at any time by following the procedures made available through the Platform or by contacting FixFlowIQ.
Account deletion requests are subject to applicable legal obligations, including obligations to retain certain records for fraud prevention, legal compliance, dispute resolution, tax reporting, accounting, security, or other legitimate business purposes.
Deletion of an account does not automatically cancel pending Bookings, ongoing disputes, payment obligations, or other responsibilities that arose before the account was deleted.
By creating an account, you agree to receive communications related to your use of the Platform, including account verification messages, security notifications, booking confirmations, service updates, payment receipts, legal notices, technical alerts, and other administrative communications necessary for the operation of the Platform.
You understand that certain communications are essential to providing the Platform and cannot be opted out of while your account remains active.
You are solely responsible for all activity conducted through your account, whether performed by you or by another person using your credentials, except where prohibited by applicable law.
If you become aware of unauthorized access or suspected misuse of your account, you must promptly notify FixFlowIQ so appropriate security measures can be taken.
Customers are responsible for using the Platform honestly, responsibly, and in accordance with these Terms.
By submitting a Repair Request or using the Platform, you agree to comply with all applicable laws and to act in good faith throughout the booking and repair process.
You agree to provide complete and accurate information when submitting a Repair Request, including, where applicable:
Vehicle year, make, and model
Vehicle Identification Number (VIN), if requested
Vehicle mileage, when known
Description of the problem or requested service
Warning lights or symptoms
Photographs or videos, if available
Current vehicle condition
Vehicle location
Preferred appointment dates and times
Any other information reasonably requested through the Platform
Providing inaccurate, incomplete, or misleading information may affect the accuracy of Quotes, scheduling, pricing, repair recommendations, or Provider availability.
You represent and warrant that you have the legal authority to request services for the vehicle identified in your Repair Request.
If you are not the vehicle owner, you represent that you have the owner's permission or other legal authority to authorize inspections, diagnostics, repairs, towing, or other requested services.
Customers are solely responsible for reviewing, comparing, and evaluating all Quotes received through the Platform.
You acknowledge that:
Quotes may vary between Providers.
Different Providers may recommend different repair methods.

Selecting a Provider is solely your decision.
FixFlowIQ does not recommend one Provider over another and does not guarantee that any Quote represents the best value or most appropriate repair solution.
Customers are solely responsible for deciding whether to authorize any repair or automotive service.
You should review all pricing, labor charges, parts costs, estimated completion times, warranty information, and repair recommendations directly with the selected Provider before authorizing work.
Once you authorize a Provider to perform services, any agreement regarding those services is between you and the Provider, except for any applicable platform fees payable to FixFlowIQ.
You are responsible for ensuring that the Provider has reasonable access to the vehicle at the agreed appointment time.
This includes, where applicable:
Providing the correct service location.
Making the vehicle reasonably accessible.
Arranging access to keys or security systems when necessary.
Ensuring that required permissions have been obtained for work performed on private property.
Informing the Provider of any known safety concerns or access restrictions.
Delays caused by inaccurate location information or lack of vehicle access may result in rescheduling, additional charges imposed by the Provider, or cancellation of the appointment.
You agree not to knowingly request service for a vehicle that presents an undisclosed and unreasonable safety hazard to a Provider.
Customers should disclose known issues that may affect the safe performance of services, including, when known:
Fuel leaks
Electrical hazards
Fire damage
Biohazards
Chemical exposure
Structural instability
Dangerous modifications
Aggressive animals at the service location
Other conditions that could reasonably pose a risk to the Provider
Except for any Booking Fee or other platform fee payable to FixFlowIQ, Customers are solely responsible for paying the selected Provider for automotive services in accordance with the agreement between the Customer and the Provider.
FixFlowIQ is not responsible for collecting, holding, distributing, or guaranteeing payment for automotive services unless expressly stated otherwise through the Platform.
Customers agree to communicate respectfully and professionally with Providers.
You agree not to:
Harass, threaten, intimidate, or abuse Providers.
Discriminate against Providers based on protected characteristics.
Use obscene, hateful, or unlawful language.
Provide knowingly false information.
Attempt to coerce Providers into performing unsafe or unlawful work.
Engage in fraudulent conduct.
Customers agree to use the Platform only for lawful purposes.
You may not request services intended to facilitate illegal activity, fraud, vehicle theft, odometer tampering, emissions violations, title fraud, or any other unlawful conduct.
FixFlowIQ reserves the right to reject, remove, or report Repair Requests that appear to violate applicable law.
Customers are responsible for inspecting completed repairs and promptly addressing any concerns directly with the Provider.
Any warranties regarding labor, workmanship, parts, or repair quality are provided, if at all, by the Provider and not by FixFlowIQ unless expressly stated in writing.
Customers are encouraged to leave honest, fair, and accurate reviews based on their genuine experience.
Reviews must not:
Contain false or misleading statements.
Include defamatory content.
Contain threats or harassment.
Reveal another person's private information.
Be submitted in exchange for compensation unless clearly disclosed.
Be used to manipulate ratings or unfairly damage a Provider's reputation.
FixFlowIQ reserves the right to review, moderate, remove, or decline to publish reviews that violate these Terms or applicable law.
To protect the integrity of the marketplace, Customers agree not to intentionally use the Platform to identify Providers for the purpose of avoiding applicable Booking Fees or other authorized Platform charges.
Attempts to circumvent Platform policies or payment requirements may result in suspension or termination of your account.
Nothing in this section prohibits Customers and Providers from continuing their independent business relationship after a Booking has been completed, provided they comply with these Terms and any other applicable agreements.
Customers acknowledge that they are solely responsible for their decisions regarding:
Selecting a Provider.
Accepting or rejecting Quotes.
Authorizing repairs.
Approving costs.
Reviewing warranties.
Inspecting completed work.
Determining whether services meet their expectations.
FixFlowIQ provides the technology marketplace through which Customers and Providers connect but does not make these decisions on behalf of Customers.
Providers participate on the Platform as independent businesses.
By creating a Provider account, submitting Quotes, accepting Repair Requests, or performing Services through the Platform, each Provider acknowledges and agrees that it is solely responsible for the operation of its business and for all automotive services it provides.
Nothing in these Terms creates an employment, agency, franchise, partnership, joint venture, fiduciary, or contractor relationship between FixFlowIQ and any Provider.
Providers represent and warrant that they will maintain all licenses, permits, registrations, certifications, and other legal authorizations required to perform the automotive services they offer.
Providers agree to comply with all applicable federal, state, and local laws, regulations, safety requirements, environmental laws, consumer protection laws, tax obligations, warranty-related requirements, and licensing requirements.
Providers are solely responsible for ensuring that they remain legally authorized to conduct business and perform the Services they offer in every jurisdiction in which they operate.
Providers are solely responsible for maintaining appropriate insurance coverage for their business operations.
Depending on the Services offered, this may include:
Commercial General Liability Insurance
Garage Liability Insurance
Garagekeepers Insurance
Commercial Automobile Insurance
Workers' Compensation Insurance, where required by law
Professional Liability or Errors and Omissions Insurance, where applicable
Any other insurance required by Applicable Laws or reasonably requested by FixFlowIQ
FixFlowIQ may request proof of insurance at any time. Failure to provide satisfactory documentation may result in suspension, restriction, loss of verification status, removal of applicable badges or program designations, or removal from the Platform.
Providers agree to maintain accurate, complete, and current business information at all times, including:
Business name
Business address
Service areas
Contact information
Business hours
Licensing information
Insurance information
Certifications
Services offered
Pricing information, where displayed
Warranty Information, where displayed
Other information requested by FixFlowIQ
Providers must promptly update their account whenever material information changes.
Providers may not knowingly display outdated, inaccurate, incomplete, deceptive, or misleading information through the Platform.
Providers are solely responsible for preparing and submitting their own Quotes.
Providers agree that Quotes should be prepared in good faith based on the information reasonably available at the time.
Providers are responsible for:
Labor pricing
Parts pricing
Diagnostic fees
Taxes
Additional charges
Estimated completion times
Warranty terms
Repair recommendations
Parts or materials proposed
Any assumptions, exclusions, or limitations included in the Quote
FixFlowIQ does not create, review, approve, negotiate, or guarantee Provider Quotes.
If the final cost or scope of work materially changes from a Quote, the Provider is responsible for clearly communicating the change to the Customer and obtaining any authorization required by Applicable Laws before proceeding.
Providers are solely responsible for the quality, safety, legality, accuracy, and completeness of the Services they perform.
Providers agree to perform Services:
Professionally
Safely
In a commercially reasonable manner
In compliance with Applicable Laws
Using appropriate tools and equipment
Consistent with generally accepted automotive industry practices
In accordance with any representations or commitments made to the Customer
Any warranties offered regarding labor, workmanship, parts, or Services are solely the responsibility of the Provider unless expressly stated otherwise in writing by FixFlowIQ.
Providers agree to conduct business honestly, ethically, and transparently.
Providers shall not:
Knowingly recommend unnecessary repairs
Misrepresent the condition of a vehicle
Submit fraudulent, deceptive, or misleading Quotes
Misrepresent parts, labor, Services, warranties, discounts, or promotions
Charge unauthorized fees
Substitute inferior or materially different parts without appropriate disclosure
Misrepresent certifications, qualifications, licenses, insurance, experience, or business status
Make false or misleading warranty claims
Advertise warranty coverage that the Provider does not actually offer
Engage in deceptive, unfair, fraudulent, or unlawful business practices
Providers agree to communicate with Customers in a respectful, professional, accurate, and timely manner.
Providers are responsible for clearly communicating:
Repair recommendations
Pricing
Estimated completion times
Appointment availability
Delays
Additional work requiring authorization
Warranty Information
Warranty limitations and exclusions
Warranty claim procedures, when applicable
Any material changes affecting the repair or service
Providers must not intentionally conceal material information that would reasonably affect a Customer's decision to authorize Services.
Providers participating in the Platform agree to uphold the FixFlowIQ Verified Standards™ and any additional marketplace standards established by FixFlowIQ.
Failure to comply with these standards may result in warnings, restrictions, suspension, loss of Verified Provider status, loss of badges or program designations, removal from the Preferred Partner Program, or termination of Platform access.
Participation in the FixFlowIQ Verified Standards™ program does not alter the independent relationship between FixFlowIQ and the Provider and does not constitute a warranty or guarantee by FixFlowIQ regarding the Provider's Services.
Providers participating in the Preferred Partner Program agree to honor the discounts, promotions, priority service commitments, or other benefits they have committed to offer through their separate agreement with FixFlowIQ.
Providers are solely responsible for administering and honoring those offers in accordance with the terms communicated to Customers and the applicable agreement with FixFlowIQ.
A Provider that applies for, qualifies for, accepts, or displays a Warranty-Backed Provider designation or Warranty Badge agrees to comply with the requirements of this subsection.
Warranty-Backed Providers are solely responsible for establishing, maintaining, administering, and honoring their Provider Warranties.
A Warranty-Backed Provider must:
Offer genuine warranty coverage applicable to the Services represented as covered
Clearly disclose the duration of the warranty
Clearly disclose any applicable mileage limitation
Clearly identify whether the warranty covers labor, parts, workmanship, or other Services
Clearly disclose material limitations, exclusions, conditions, and eligibility requirements
Provide accurate and current Warranty Information to FixFlowIQ and Customers
Avoid false, deceptive, exaggerated, or misleading warranty representations
Honor valid warranty obligations in accordance with the Provider's stated terms and Applicable Laws
Provide Customers with reasonable instructions for submitting a warranty claim
Respond to warranty-related communications within a commercially reasonable period
Maintain records reasonably sufficient to document its warranty terms and applicable covered Services
Promptly notify FixFlowIQ if the Provider modifies, suspends, restricts, or discontinues its warranty program
A Provider may not use the Warranty-Backed Provider designation or Warranty Badge to imply that FixFlowIQ provides, guarantees, insures, underwrites, administers, or is financially responsible for the Provider Warranty.
Warranty claims are primarily matters between the Customer and the applicable Provider.
The Provider is solely responsible for:
Evaluating warranty claims
Determining coverage under its stated warranty terms
Requesting reasonable supporting documentation
Communicating claim decisions
Performing covered rework or replacement
Providing any refund, credit, replacement part, repair, or other remedy required under the Provider Warranty or Applicable Laws
Maintaining records relating to warranty claims and outcomes
FixFlowIQ may, at its discretion, provide communication tools, customer support, documentation assistance, complaint intake, or other marketplace support relating to a warranty dispute. Such assistance does not make FixFlowIQ the warrantor, claims administrator, insurer, arbitrator, or responsible party for the underlying Provider Warranty.
FixFlowIQ may establish, modify, review, or enforce eligibility criteria for participation in the Warranty-Backed Provider program.
FixFlowIQ may refuse, suspend, restrict, or remove a Warranty Badge or Warranty-Backed Provider designation if FixFlowIQ reasonably believes that:
The Provider no longer offers the represented warranty
Warranty Information is inaccurate, outdated, incomplete, or misleading
The Provider has materially misrepresented warranty coverage
The Provider repeatedly fails to respond to legitimate warranty claims
The Provider repeatedly fails to honor valid warranty obligations
The Provider violates these Terms, Platform policies, or Applicable Laws
Continued display of the designation could mislead Customers or damage the integrity of the Marketplace
Removal of a Warranty Badge does not cancel, reduce, transfer, or eliminate any warranty obligation the Provider already owes to a Customer.
Providers should make reasonable efforts to:
Arrive on time for scheduled appointments
Notify Customers promptly of delays
Communicate scheduling conflicts
Perform authorized work within a reasonable timeframe
Inform Customers when additional repairs are recommended
Communicate promptly when circumstances materially affect completion of Services
Unexpected circumstances may occasionally affect scheduling. Providers are expected to communicate such circumstances promptly and professionally.
Providers are solely responsible for:
Reporting income
Paying all applicable taxes
Payroll obligations
Business expenses
Employee compensation
Government filings
Accounting records
Refunds or financial obligations owed directly to Customers
Any other financial obligations arising from their business operations
FixFlowIQ does not withhold payroll taxes or provide employee benefits to Providers.
Providers independently determine:
Labor rates
Parts pricing
Diagnostic fees
Travel fees
Shop supplies
Service charges
Discounts
Promotions
Warranty-related pricing, where applicable
FixFlowIQ does not establish minimum or maximum repair prices, negotiate Provider pricing, or control Provider compensation.
Providers may not:
Submit false business information
Misrepresent licenses or insurance
Perform Services they are not qualified or legally authorized to perform
Discriminate against Customers in violation of Applicable Laws
Harass, threaten, or intimidate Users
Engage in fraudulent activity
Manipulate reviews or ratings
Misrepresent warranty coverage or Warranty-Backed Provider status
Continue displaying or claiming a Warranty-Backed Provider designation after FixFlowIQ removes or revokes it
Use the Platform to facilitate unlawful conduct
Interfere with the operation or security of the Platform
Circumvent Platform policies or applicable Booking Fees
Violations may result in warning, restriction, suspension, loss of badges or program status, termination, legal action, or referral to appropriate authorities where warranted.
Providers are solely responsible for the actions, omissions, conduct, supervision, training, qualifications, and legal compliance of their owners, employees, contractors, subcontractors, technicians, agents, and other representatives.
Any person performing Services or administering warranty obligations on behalf of a Provider does so under the Provider's responsibility and not on behalf of FixFlowIQ.
Providers acknowledge that continued participation on the Platform is conditioned upon ongoing compliance with these Terms, Applicable Laws, and any additional Provider policies or agreements issued by FixFlowIQ.
FixFlowIQ reserves the right to request updated documentation, conduct periodic reviews, review Warranty Information, investigate complaints, or require additional information reasonably necessary to confirm continued eligibility for participation in the Platform or any Provider program or designation.
Failure to cooperate with a reasonable compliance review may result in suspension, restriction, removal of badges or program designations, or termination of Platform access.
Customers may use the Platform to submit a Repair Request for automotive-related services.
A Repair Request may include information such as:
Vehicle year, make, and model
Vehicle Identification Number (VIN), where requested
Mileage
Description of the issue or requested service
Photos or videos
Vehicle location
Preferred appointment dates or times
Additional information requested through the Platform
Customers are responsible for ensuring that all submitted information is accurate and complete to the best of their knowledge.
Upon submission, FixFlowIQ may use automated systems, artificial intelligence, filtering tools, geographic location, service categories, Provider availability, service areas, vehicle information, or other marketplace criteria to distribute or display Repair Requests to eligible Providers.
FixFlowIQ does not guarantee that every Repair Request will be distributed to every Provider or that a Customer will receive a specific number of Quotes.
While the Platform may be designed to allow Customers to receive multiple Quotes, the number of Quotes received depends on marketplace activity, Provider participation, service availability, and other factors outside FixFlowIQ's control.
Providers independently determine whether to submit a Quote in response to a Repair Request.
Each Quote is prepared solely by the Provider and may include:
Estimated labor costs
Estimated parts costs
Diagnostic fees
Service recommendations
Estimated completion times
Appointment availability
Warranty information
Additional terms established by the Provider
Quotes are estimates based on the information available at the time they are prepared. Additional inspection or diagnostics may reveal conditions that require changes to pricing, parts, labor, or repair recommendations.
FixFlowIQ does not prepare, verify, negotiate, or guarantee the accuracy, completeness, or suitability of any Quote.
Customers are encouraged to review all available Quotes carefully before selecting a Provider.
When comparing Quotes, Customers should consider factors such as:
Scope of the proposed repair
Estimated pricing
Completion timeframe
Warranty information
Provider qualifications
Customer reviews
Communication
Any other factors the Customer considers important
The decision to accept or reject a Quote rests solely with the Customer.
When a Customer accepts a Quote or otherwise selects a Provider through the Platform, the Customer is expressing an intent to proceed with that Provider, subject to completion of any required booking steps and payment of any applicable Booking Fee.
FixFlowIQ does not guarantee that a selected Provider will remain available until the booking is confirmed.
A Booking is considered confirmed only after all required booking steps have been completed, including payment of any applicable Booking Fee and any additional confirmation requirements communicated through the Platform.
Until a Booking is confirmed, appointment times and Provider availability may change.
Customers acknowledge that many automotive issues cannot be fully diagnosed without a physical inspection or additional testing.
Accordingly, a Provider may determine that:
Additional repairs are necessary.
Different parts are required.
Labor time differs from the original estimate.
Previously unknown conditions exist.
The original Quote should be revised.
Providers should obtain Customer authorization before performing additional work that materially changes the agreed scope of service or price, unless otherwise permitted by applicable law or prior written authorization.
Customers and Providers are responsible for coordinating appointment details, including:
Date and time
Service location
Vehicle access
Arrival instructions
Any special requirements
Customers and Providers should promptly communicate any scheduling changes or delays.
Customers may cancel a Repair Request or Booking in accordance with the Platform's Cancellation Policy and any additional terms communicated during the booking process.
Cancellation of a Booking may affect eligibility for refunds of Booking Fees or other charges, as described elsewhere in these Terms or applicable policies.
Providers should avoid canceling confirmed appointments except when reasonably necessary.
If a Provider must cancel, the Provider should notify the Customer as soon as reasonably possible and, where appropriate, explain the reason for the cancellation.
FixFlowIQ is not responsible for losses resulting from Provider cancellations, although we may, at our discretion, assist Customers in locating another available Provider through the Platform.
FixFlowIQ does not guarantee:
That a Provider will submit a Quote.
That a Customer will receive multiple Quotes.
That a Provider will accept a Repair Request.
That a selected Provider will remain available.
That appointments can be scheduled at a requested date or time.
That services will be available in every geographic area.
Marketplace activity depends on the participation and availability of independent Providers.
Once a Customer authorizes a Provider to perform automotive services, the agreement for those services is solely between the Customer and the Provider.
Except for any applicable Booking Fee or other Platform fees owed directly to FixFlowIQ, the Provider is solely responsible for:
Performing the services.
Determining repair methods.
Supplying labor and parts.
Honoring warranties.
Collecting payment for automotive services.
Resolving service-related issues with the Customer.
FixFlowIQ is not a party to the agreement for automotive services between the Customer and the Provider.
FixFlowIQ's role in the booking process is limited to providing the technology platform that enables Customers and Providers to connect, exchange information, schedule appointments, and facilitate Bookings.
Nothing in the booking process shall be interpreted as creating an employment, agency, partnership, joint venture, franchise, or contractor relationship between FixFlowIQ and any Provider or Customer.
FixFlowIQ does not guarantee:
That any repair will resolve the reported issue.
That a diagnosis will be correct.
That repairs will be completed within an estimated timeframe.
That replacement parts will be available.
That repair costs will remain unchanged after inspection.
That a Provider will meet a Customer's expectations.
Customers acknowledge that automotive repairs often involve variables that cannot be fully determined until a vehicle has been inspected or disassembled.
Accordingly, repair outcomes, costs, and timelines may differ from initial expectations or estimates.
FixFlowIQ may charge Customers a Booking Fee to facilitate a confirmed booking between a Customer and a Provider through the Platform.
The Booking Fee is charged for access to and use of the Platform's marketplace services, including facilitating Repair Requests, Provider matching, communications, scheduling, booking technology, payment processing, platform maintenance, customer support, security, fraud prevention, and continued development of the Platform.
The Booking Fee is separate from the cost of automotive services performed by a Provider.
Unless expressly stated otherwise through the Platform, all charges for labor, parts, diagnostic services, taxes, towing, storage, shop supplies, disposal fees, travel charges, or other automotive-related services are determined solely by the Provider.
Customers are responsible for paying the Provider directly for automotive services in accordance with the agreement between the Customer and the Provider.
FixFlowIQ does not establish repair pricing or control the amount charged by independent Providers.
Payments processed through the Platform may be facilitated by one or more third-party payment processors.
By making a payment through the Platform, you authorize FixFlowIQ and its payment processing partners to:
Process authorized payments.
Verify payment information.
Collect applicable Booking Fees.
Issue receipts.
Process approved refunds where applicable.
Take reasonable steps to prevent fraud or unauthorized transactions.
Use of third-party payment processors is subject to their separate terms of service and privacy policies.
By submitting payment information, you represent and warrant that:
You are authorized to use the selected payment method.
The payment information provided is accurate and current.
You authorize the applicable charges associated with your booking.
You will maintain sufficient funds or available credit to complete authorized transactions.
Providing false payment information or attempting to make unauthorized payments may result in suspension or termination of your account and other remedies available under applicable law.
FixFlowIQ does not store complete payment card information unless expressly required for a service and permitted by applicable law.
Payment information is generally processed by secure third-party payment providers that employ industry-standard security measures.
While FixFlowIQ takes reasonable steps to protect payment-related information, no method of electronic transmission or storage can be guaranteed to be completely secure.
Unless otherwise required by applicable law or expressly stated in a separate refund policy, Booking Fees are generally non-refundable once a booking has been confirmed and the marketplace services associated with that booking have been provided.
However, FixFlowIQ may, in its sole discretion, issue a full or partial refund of a Booking Fee in appropriate circumstances, including but not limited to:
Duplicate payments.
Technical or billing errors.
Unauthorized transactions verified by investigation.
Circumstances where a booking could not reasonably be completed due to a Platform error.
Other situations where FixFlowIQ determines that a refund is appropriate.
Nothing in this section obligates FixFlowIQ to provide a refund except where required by applicable law or expressly stated by the Company.
Except for Booking Fees or other Platform fees expressly collected by FixFlowIQ, Providers are solely responsible for collecting payment for automotive services.
FixFlowIQ is not responsible for:
Collecting repair payments.
Holding repair funds in escrow.
Guaranteeing payment to Providers.
Enforcing payment obligations between Customers and Providers.
Resolving payment disputes relating solely to automotive services.
Customers and Providers are each responsible for any taxes applicable to their use of the Platform or the automotive services they provide or receive, except to the extent FixFlowIQ is required by law to collect or remit certain taxes related to Platform fees.
Providers remain solely responsible for determining, collecting, reporting, and remitting any taxes applicable to their automotive services.
If a payment is declined, reversed, disputed, refunded by the payment provider, or otherwise fails to process, FixFlowIQ may:
Cancel or suspend the associated Booking.
Require an alternative payment method.
Suspend access to certain Platform features.
Recover amounts lawfully owed.
Take other actions reasonably necessary to protect the Platform or its Users.
Customers agree not to initiate a chargeback or payment dispute in bad faith.
If a chargeback is initiated, FixFlowIQ reserves the right to:
Contest the chargeback.
Provide transaction records and booking documentation to the payment processor or financial institution.
Suspend the associated account while the dispute is pending.
Recover amounts lawfully owed where permitted by applicable law.
Nothing in this section limits a Customer's legal rights regarding legitimate billing disputes.
FixFlowIQ may investigate payments or transactions that appear suspicious, fraudulent, unauthorized, or otherwise inconsistent with normal Platform activity.
To protect Users and the Platform, FixFlowIQ may delay processing, request additional verification, temporarily suspend transactions, or decline payments where reasonably necessary.
From time to time, FixFlowIQ may offer promotional credits, coupons, referral rewards, Booking Fee discounts, or other promotional incentives.
Unless otherwise stated:
Promotions have no cash value.
Promotions may be modified or discontinued at any time.
Promotions may be subject to expiration dates.
Promotions may not be transferred, sold, or redeemed except as expressly permitted.
Abuse or manipulation of promotional offers may result in cancellation of the promotion and suspension of the associated account.
FixFlowIQ may introduce additional payment features in the future, including subscriptions, memberships, financing options, deposits, installment payments, digital wallets, or other payment-related services.
Any additional payment services will be governed by these Terms together with any supplemental terms presented at the time such services become available.
FixFlowIQ reserves the right to modify, introduce, or discontinue Booking Fees or other Platform fees at any time, subject to applicable law.
Any revised fees will apply prospectively and will be communicated through the Platform or by other reasonable means before taking effect.
FixFlowIQ does not warrant that payment processing services will be uninterrupted, error-free, or continuously available.
Temporary interruptions may occur due to maintenance, technical issues, banking systems, payment processor outages, fraud prevention measures, internet disruptions, or other circumstances beyond FixFlowIQ's reasonable control.
Because FixFlowIQ operates as a technology marketplace connecting Customers with independent Providers, cancellations, rescheduling, and refunds may involve both Platform policies and agreements made directly between Customers and Providers.
Customers and Providers are encouraged to communicate promptly regarding any changes to scheduled appointments.
A Customer may cancel a Repair Request at any time before a Provider has been selected or a Booking has been confirmed.
Cancellation of a Repair Request does not automatically entitle the Customer to a refund of any fees already paid unless otherwise required by these Terms, applicable law, or an applicable refund policy.
A Customer may request cancellation of a confirmed Booking through the Platform or by communicating directly with the Provider, where applicable.
Depending on the circumstances, cancellation may result in:
Loss of the Booking Fee.
Additional charges imposed by the Provider under the Customer's agreement with that Provider.
Rescheduling instead of cancellation.
Other consequences disclosed during the booking process.
Customers are responsible for reviewing any cancellation terms communicated by the selected Provider before authorizing services.
Providers should make reasonable efforts to honor confirmed appointments.
If a Provider must cancel a confirmed Booking, the Provider should notify the Customer as soon as reasonably possible and, when appropriate, explain the reason for the cancellation.
FixFlowIQ may, but is not obligated to:
Assist the Customer in locating another available Provider.
Facilitate communication between the Customer and another Provider.
Review the circumstances when determining whether a Booking Fee refund or credit is appropriate.
Customers and Providers may mutually agree to reschedule an appointment.
Rescheduling is subject to Provider availability and any applicable policies communicated through the Platform.
FixFlowIQ does not guarantee that the original appointment time, Provider, or pricing will remain available after a rescheduling request.
Unexpected delays may occur due to traffic, weather, emergency calls, parts availability, prior service appointments, equipment failures, staffing shortages, or other unforeseen circumstances.
Providers are expected to communicate material delays to Customers as soon as reasonably practicable.
FixFlowIQ is not responsible for losses, expenses, missed appointments, lost wages, towing costs, rental vehicle costs, or other damages arising from Provider delays.
Booking Fee refunds are governed by Section 8 of these Terms and any applicable refund policy published by FixFlowIQ.
Unless otherwise required by law or expressly approved by FixFlowIQ, Booking Fees are generally non-refundable after a Booking has been confirmed and the Platform has provided the marketplace services associated with that booking.
Nothing in this section limits FixFlowIQ's discretion to issue a full or partial refund or account credit when it determines that doing so is appropriate.
Except where expressly stated otherwise through the Platform, FixFlowIQ does not collect, hold, or distribute payment for automotive services performed by Providers.
Accordingly, requests for refunds relating to labor, parts, diagnostics, towing, roadside assistance, or other automotive services must be directed to the Provider that performed or agreed to perform those services.
Any refund for automotive services is subject to the agreement between the Customer and the Provider and applicable law.
If a dispute arises regarding:
Repair quality
Workmanship
Pricing
Parts
Warranties
Appointment scheduling
Service completion
Property damage
Other automotive services
Customers should first attempt to resolve the matter directly with the Provider.
FixFlowIQ may, at its sole discretion, provide communication tools or facilitate discussions between the parties; however, FixFlowIQ is not obligated to investigate, mediate, arbitrate, or resolve disputes between Customers and Providers.
If a cancellation, duplicate booking, payment issue, or scheduling problem results directly from a confirmed technical error of the Platform, FixFlowIQ may, at its sole discretion:
Cancel the affected Booking.
Issue a Booking Fee refund.
Issue an account credit.
Assist with rescheduling.
Take other reasonable corrective action.
Nothing in this section creates an obligation for FixFlowIQ to provide compensation beyond what is required by applicable law.
Appointments may need to be canceled or rescheduled because of circumstances beyond the reasonable control of the Customer, the Provider, or FixFlowIQ.
Such circumstances may include:
Severe weather
Natural disasters
Government orders
Public emergencies
Power outages
Transportation disruptions
Labor disruptions
Medical emergencies
Safety concerns
Other force majeure events
In such situations, the affected parties are encouraged to cooperate in good faith to reschedule services when reasonably possible.
Cancellation of a Booking does not automatically terminate:
Outstanding payment obligations.
Previously authorized repair charges.
Warranty obligations between the Customer and Provider.
Rights or obligations that accrued before cancellation.
Any provisions of these Terms intended to survive termination.
The rights and obligations of the parties shall continue to the extent necessary to enforce these Terms or applicable law.
The FixFlowIQ Preferred Partner Program is a voluntary program through which approved Providers may agree to offer exclusive discounts, promotions, incentives, or other benefits to eligible FixFlowIQ Customers.
The purpose of the Preferred Partner Program is to encourage long-term relationships between Customers and participating Providers while helping Customers receive additional value through the Platform.
Participation in the Preferred Partner Program is subject to these Terms and any separate agreement entered into between FixFlowIQ and the participating Provider.
Participation in the Preferred Partner Program is voluntary.
No Provider is required to participate, and participation is subject to approval by FixFlowIQ.
FixFlowIQ reserves the right to approve, deny, suspend, revoke, or terminate participation in the Preferred Partner Program at any time, with or without notice, to the extent permitted by applicable law.
Providers participating in the Preferred Partner Program agree to:
Honor the discounts or promotions they have committed to offer.
Clearly communicate the terms and conditions of any promotion.
Apply eligible discounts in a fair and consistent manner.
Promptly notify FixFlowIQ of any changes to their promotional offerings.
Maintain compliance with these Terms and any applicable Preferred Partner Agreement.
Providers are solely responsible for administering, honoring, and funding any discounts, promotions, or special offers they choose to provide.
Eligibility for Preferred Partner discounts, promotions, or incentives may depend on factors including:
Completion of a Booking through the Platform.
Compliance with these Terms.
Eligibility requirements established for a particular promotion.
Geographic availability.
Other conditions disclosed at the time of the offer.
Some promotions may have expiration dates, usage limitations, minimum purchase requirements, or other restrictions.
Although participating Providers may offer discounts or promotional pricing, FixFlowIQ does not guarantee:
That every Provider participates in the Preferred Partner Program.
That every Customer will qualify for a discount.
The amount of any discount.
That promotional pricing will always be available.
That a Preferred Partner will offer the lowest available price.
Actual savings, if any, will vary depending on the Provider, location, service requested, vehicle condition, and the specific terms of the applicable promotion.
Participation in the Preferred Partner Program does not create an employment, agency, franchise, partnership, joint venture, fiduciary, or contractor relationship between FixFlowIQ and any participating Provider.
Providers remain independent businesses and retain sole responsibility for:
Pricing.
Repair recommendations.
Workmanship.
Warranties.
Customer service.
Compliance with applicable laws.
Performance of automotive services.
Participating Providers may modify or discontinue future promotional offers in accordance with the terms of their agreement with FixFlowIQ and applicable law.
Such modifications generally apply prospectively and do not affect discounts already honored or otherwise required by law or contract.
FixFlowIQ makes reasonable efforts to display promotional information accurately; however, promotional details provided through the Platform may occasionally contain typographical errors, technical inaccuracies, outdated information, or other inadvertent errors.
FixFlowIQ reserves the right to correct such errors and to update promotional information without prior notice, provided that doing so does not alter rights that have already vested under applicable law or contract.
A Provider may be removed from the Preferred Partner Program if the Provider:
Fails to honor agreed discounts.
Violates these Terms.
Violates the Preferred Partner Agreement.
Receives repeated substantiated customer complaints.
Provides false or misleading information.
Loses required licenses or insurance.
Engages in fraudulent, deceptive, or unlawful conduct.
Otherwise fails to meet the standards established by FixFlowIQ.
Removal from the Preferred Partner Program does not automatically terminate the Provider's general access to the Platform unless separately determined by FixFlowIQ.
FixFlowIQ may identify participating Providers as Preferred Partners through badges, labels, search filters, promotional materials, or other indicators on the Platform.
These designations are intended solely to indicate participation in the Preferred Partner Program and should not be interpreted as a guarantee of repair quality, workmanship, pricing, customer satisfaction, or future performance.
FixFlowIQ reserves the right to modify, expand, suspend, or discontinue the Preferred Partner Program, including eligibility requirements, participation standards, promotional structures, branding, or related features, at any time.
Such changes will apply prospectively and will not affect rights that have already accrued under applicable agreements or applicable law.
The Preferred Partner Program is intended to enhance the Customer experience by facilitating access to participating Providers and their promotional offerings.
Except as expressly stated in a separate written agreement, FixFlowIQ does not sponsor, guarantee, insure, underwrite, or assume responsibility for any discount, promotion, repair, service, warranty, or representation made by an independent Provider participating in the Program.
FixFlowIQ maintains a Provider review and verification program to help promote professionalism, transparency, and customer confidence throughout the Platform.
As part of this program, FixFlowIQ may review information submitted by Providers during the application or renewal process. The verification process is intended to assist in evaluating whether a Provider meets FixFlowIQ's marketplace participation requirements.
Participation in the verification program does not create any employment, agency, partnership, joint venture, franchise, or contractor relationship between FixFlowIQ and a Provider.
As part of the application or ongoing participation process, FixFlowIQ may request or review information including, but not limited to:
Business registration information.
Business licenses.
Insurance documentation.
Professional certifications.
Business address and contact information.
Service areas.
Photographs of business facilities or equipment.
Business history.
Identity verification information.
Customer service practices.
Other information reasonably determined by FixFlowIQ to be relevant.
FixFlowIQ may approve, deny, request additional information, or revoke verification at its sole discretion, subject to applicable law.
Providers who satisfy FixFlowIQ's verification requirements may receive a "Verified Provider" designation or similar indicator on the Platform.
The designation indicates only that the Provider satisfied FixFlowIQ's review requirements at the time verification was granted.
Verification is not:
A professional certification.
A government endorsement.
A warranty.
A guarantee of workmanship.
A guarantee of pricing.
A guarantee of future performance.
A guarantee of customer satisfaction.
A representation that the Provider will always comply with applicable laws or industry standards.
Customers remain solely responsible for evaluating Providers before authorizing any automotive services.
Verification is an ongoing process.
FixFlowIQ may periodically request updated documentation or additional information to confirm continued eligibility.
Providers agree to promptly notify FixFlowIQ of material changes affecting their eligibility, including changes involving:
Licensing.
Insurance coverage.
Business ownership.
Legal status.
Business location.
Service offerings.
Other information material to participation on the Platform.
Failure to provide requested information may result in suspension or removal of Verified Provider status or access to the Platform.
Providers participating on the Platform may be required to agree to the FixFlowIQ Verified Standards™, which are intended to promote consistent customer service and ethical business practices.
These standards include commitments to:
Honest Service Recommendations.
Transparent Pricing.
Fair and Accurate Estimates.
Clear Customer Communication.
Evidence of Repairs Upon Request, where reasonably available.
Timely Service.
Quality Workmanship.
Professional and respectful customer interactions.
These standards represent marketplace participation expectations and do not constitute warranties, guarantees, or contractual promises made by FixFlowIQ regarding the actions of any Provider.
Providers remain solely responsible for:
Their employees and representatives.
Business operations.
Repair recommendations.
Diagnostic decisions.
Pricing.
Labor.
Parts.
Customer communications.
Warranty obligations.
Compliance with applicable laws.
All automotive services they perform.
FixFlowIQ does not supervise, direct, or control the manner in which Providers perform automotive services.
Customers acknowledge that the Verified Provider designation is one factor that may be considered when selecting a Provider.
Customers should independently evaluate all available information, including:
Quotes.
Reviews.
Experience.
Communication.
Pricing.
Warranties.
Availability.
Other factors the Customer considers important.
Customers remain solely responsible for deciding whether to authorize automotive services.
FixFlowIQ may suspend, revoke, or remove a Provider's verification status at any time if the Provider:
No longer satisfies verification requirements.
Provides false or misleading information.
Fails to maintain required licenses or insurance.
Violates these Terms.
Violates applicable laws.
Receives repeated substantiated complaints.
Engages in fraudulent, deceptive, abusive, or unsafe conduct.
Otherwise fails to satisfy FixFlowIQ's marketplace participation standards.
Removal of verification does not necessarily terminate a Provider's account unless separately determined by FixFlowIQ.
Although FixFlowIQ strives to maintain a high-quality marketplace, FixFlowIQ does not guarantee:
The qualifications of any Provider.
The accuracy of information submitted by a Provider.
The quality of repairs.
Future compliance with the Verified Standards™.
Customer satisfaction.
Safety of repairs.
Availability of Providers.
The outcome of any automotive service.
Verification reflects information available at the time of review and should not be interpreted as an assurance of future conduct or performance.
FixFlowIQ reserves the right to modify, expand, suspend, or discontinue its verification requirements, review procedures, eligibility criteria, Verified Standards™, badges, designations, or related marketplace programs at any time.
Such modifications may apply prospectively to existing and future Providers.
The verification program is intended to support marketplace integrity and improve the overall Customer experience.
Nothing in the verification process alters the independent relationship between Customers and Providers or shifts responsibility for automotive services from the Provider to FixFlowIQ.
Except as expressly stated in these Terms, FixFlowIQ's role remains limited to operating the technology marketplace through which Customers and independent Providers connect.
FixFlowIQ may use artificial intelligence ("AI"), machine learning, automated decision-support tools, recommendation systems, matching algorithms, predictive technologies, natural language processing, automation, and other software technologies (collectively, "AI Features") to improve the operation of the Platform.
These technologies are intended to enhance marketplace efficiency, improve the user experience, and assist Customers and Providers throughout the booking process.
AI Features may be used to assist with activities including, but not limited to:
Matching Repair Requests with eligible Providers.
Categorizing requested automotive services.
Identifying relevant Provider specialties.
Organizing search results.
Improving marketplace efficiency.
Detecting duplicate requests.
Fraud prevention and security monitoring.
Customer support assistance.
Scheduling assistance.
Platform analytics.
Service recommendations based on submitted information.
Other operational functions designed to improve the Platform.
The specific AI Features available may change over time.
AI Features are provided solely for informational and operational purposes.
AI-generated information, recommendations, summaries, classifications, or other outputs are not professional automotive advice and should not be relied upon as a substitute for inspection, diagnosis, or recommendations provided by a qualified automotive professional.
Customers remain responsible for evaluating Providers and making their own decisions regarding repairs.
Although FixFlowIQ strives to improve the quality of AI Features, automated systems may occasionally produce incomplete, inaccurate, outdated, or incorrect information.
FixFlowIQ does not warrant or guarantee that AI Features will:
Correctly identify every vehicle issue.
Accurately categorize every Repair Request.
Recommend the most qualified Provider.
Recommend the lowest-priced Provider.
Recommend the closest Provider.
Recommend the fastest available Provider.
Detect every fraudulent transaction.
Operate without interruption or error.
Users should independently evaluate all information before making decisions.
The Platform may automatically route or display Repair Requests to Providers based on factors including:
Service category.
Vehicle information.
Geographic location.
Service area.
Provider availability.
Provider specialties.
Marketplace activity.
Customer-selected preferences.
Other marketplace criteria determined by FixFlowIQ.
The matching process is intended to facilitate marketplace operations and does not constitute an endorsement, certification, ranking, or recommendation of any Provider.
Customers and Providers remain solely responsible for exercising independent judgment when using the Platform.
Neither Customers nor Providers should rely exclusively on AI Features when making decisions regarding:
Vehicle repairs.
Safety.
Diagnostic conclusions.
Pricing.
Parts selection.
Scheduling.
Business operations.
Legal compliance.
Professional judgment should always take precedence over automated recommendations.
FixFlowIQ may update, improve, retrain, modify, replace, suspend, or discontinue AI Features at any time to improve accuracy, security, efficiency, or user experience.
AI systems may evolve over time as technology, marketplace conditions, and user needs change.
FixFlowIQ may use automated technologies to identify suspicious activity, unauthorized access, fraudulent transactions, spam, abuse, duplicate accounts, or other conduct that may threaten the integrity or security of the Platform.
Such systems may temporarily restrict accounts, delay transactions, request additional verification, or take other reasonable actions designed to protect Users and the Platform.
The Platform may use automated technologies to generate or deliver:
Booking confirmations.
Appointment reminders.
Service notifications.
Status updates.
Customer support responses.
Verification requests.
Payment notifications.
Security alerts.
Marketplace communications.
Other administrative messages.
Automated communications are intended to facilitate Platform operations and should not be interpreted as legal, financial, mechanical, or professional advice.
FixFlowIQ may use user feedback, marketplace performance data, anonymized usage information, and other lawful sources to improve AI Features and other Platform technologies.
Any such use will be handled in accordance with the Privacy Policy and applicable law.
Certain AI Features or other Platform technologies may be provided, supported, or enhanced by third-party technology providers.
Use of such technologies may be subject to additional terms or technical limitations established by those providers.
FixFlowIQ is not responsible for interruptions, inaccuracies, or limitations arising solely from third-party technology beyond its reasonable control.
FixFlowIQ reserves the right to determine, modify, expand, restrict, suspend, or discontinue any AI Feature, automated system, matching technology, algorithm, recommendation engine, or related Platform functionality at any time without prior notice, except where otherwise required by applicable law.
Nothing in this section obligates FixFlowIQ to maintain any specific AI Feature or automated functionality.
The Platform may allow Customers and, where applicable, Providers to submit ratings, reviews, testimonials, comments, and other feedback regarding their experiences on the Platform.
The purpose of the review system is to promote transparency, assist Users in making informed decisions, and improve the overall quality of the FixFlowIQ marketplace.
Users agree that any review, rating, or feedback submitted through the Platform will:
Be truthful and based on the User's actual experience.
Be submitted in good faith.
Be accurate to the best of the User's knowledge.
Comply with these Terms and applicable law.
Users should distinguish between opinions, personal experiences, and statements of fact.
Users may not submit reviews or feedback that:
Are knowingly false or misleading.
Are defamatory or libelous.
Contain threats, harassment, or abusive language.
Include hate speech or discriminatory content.
Reveal another person's confidential or personal information.
Infringe intellectual property rights.
Contain spam, advertisements, or promotional material unrelated to the review.
Are submitted using fake accounts or multiple accounts.
Are intended to manipulate ratings or search results.
Violate applicable law.
FixFlowIQ reserves the right to remove or restrict content that violates these Terms.
Unless expressly disclosed and permitted by applicable law, Users may not:

Threaten negative reviews to obtain discounts or refunds.
Coordinate fraudulent review campaigns.
Submit reviews on behalf of another person without authorization.
Any attempt to manipulate the integrity of the review system may result in suspension or termination of the associated account.
FixFlowIQ may, but is not obligated to, monitor, review, moderate, edit for formatting, decline to publish, remove, or restrict reviews or other User feedback that:

Appears fraudulent or deceptive.
Contains personal information.
Contains profanity or abusive content.
Is unrelated to the transaction being reviewed.
Otherwise threatens the integrity or operation of the Platform.
FixFlowIQ is not obligated to remove content solely because a User disagrees with it.
Reviews, ratings, and other User feedback represent the opinions of the individual User who submitted them.
Such content does not represent the views, opinions, recommendations, or endorsements of FixFlowIQ.
FixFlowIQ does not verify the accuracy of every review and makes no warranty regarding the completeness, reliability, or accuracy of User-submitted feedback.
Providers may be permitted to respond publicly or privately to Customer reviews through the Platform.
Responses should remain professional, respectful, and should not disclose confidential information or violate applicable privacy laws.
FixFlowIQ reserves the right to moderate Provider responses under the same standards applicable to Customer reviews.
Users retain ownership of the reviews, ratings, comments, and other feedback they submit.
By submitting such content, you grant FixFlowIQ a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, publish, display, distribute, adapt for formatting, and otherwise use the content in connection with operating, improving, promoting, and maintaining the Platform, subject to applicable law and the Privacy Policy.
This license continues for as long as reasonably necessary to operate the Platform and protect legitimate business interests, even if your account is later closed, unless otherwise required by applicable law.
Feedback submitted to FixFlowIQ regarding suggestions, ideas, feature requests, improvements, or other recommendations may be used by FixFlowIQ without obligation to compensate the submitting User.
Users acknowledge that such suggestions are voluntarily provided and may be incorporated into future versions of the Platform or related services.
FixFlowIQ may review complaints relating to reviews or ratings when reasonably appropriate.
In conducting such reviews, FixFlowIQ may consider:
Information provided by the parties.
Platform records.
Booking history.
Communications through the Platform.
Other relevant information available to FixFlowIQ.
Nothing in this section obligates FixFlowIQ to investigate every complaint or resolve disputes between Users.
To preserve trust in the Platform, FixFlowIQ may employ automated systems, manual review processes, fraud detection tools, or other measures designed to identify and address suspicious review activity.
FixFlowIQ reserves the right to suspend, remove, adjust, or otherwise limit ratings or reviews that reasonably appear to compromise the integrity of the marketplace.
FixFlowIQ does not guarantee:
The accuracy of ratings.
The completeness of reviews.
That every User will leave feedback.
That ratings accurately predict future performance.
That highly rated Providers will meet every Customer's expectations.
Reviews and ratings are only one factor Customers should consider when selecting a Provider.
The review system is intended to encourage accountability and informed decision-making throughout the marketplace.
Customers remain responsible for independently evaluating Providers, and Providers remain responsible for the services they perform.
Except as expressly stated in these Terms, FixFlowIQ does not assume responsibility for opinions, statements, or representations made by Users through the review system.
FixFlowIQ may provide communication tools that allow Customers and Providers to exchange information regarding Repair Requests, Quotes, Bookings, appointments, vehicle information, scheduling, and other matters related to the use of the Platform.
These communication tools are provided solely for the convenience of Users and to facilitate marketplace transactions.
Users are solely responsible for the content of any messages, documents, photographs, videos, attachments, or other information they send through the Platform.
By using the Platform's communication features, you represent and warrant that your communications:
Are truthful and accurate to the best of your knowledge.
Do not violate applicable law.
Do not infringe the rights of any third party.
Comply with these Terms and all Platform policies.
Users may not use the Platform to send, upload, transmit, or distribute communications that:
Are fraudulent, deceptive, or misleading.
Contain threats, harassment, intimidation, or abusive language.
Promote violence or unlawful conduct.
Contain discriminatory or hateful content.
Include obscene, sexually explicit, or offensive material.
Contain malicious software, viruses, or harmful code.
Constitute spam, phishing, or unsolicited commercial communications.
Infringe intellectual property rights.
Reveal another person's confidential or personal information without authorization.
Violate applicable law.
FixFlowIQ reserves the right to remove or restrict communications that violate these Terms.
Customers and Providers may use Platform messaging to discuss matters reasonably related to a Repair Request or Booking, including:
Vehicle symptoms.
Scheduling.
Appointment updates.
Repair recommendations.
Additional repair authorization.
Service progress.
Completion notifications.
Warranty information.
Other matters directly related to the requested automotive services.
Users should keep communications professional and relevant to the transaction.
After a Customer and Provider have connected through the Platform, they may choose to communicate using other lawful methods, such as telephone, text message, or email.
However, Users remain responsible for complying with these Terms, including any provisions relating to Booking Fees, marketplace integrity, fraud prevention, and prohibited conduct.
Nothing in this section prohibits lawful communication outside the Platform.
To the extent permitted by applicable law, FixFlowIQ may, but is not obligated to:
Monitor communications transmitted through the Platform.
Review reported messages.
Remove content that violates these Terms.
Restrict messaging privileges.
Suspend or terminate accounts for misuse of communication features.
Preserve records when reasonably necessary for security, legal compliance, fraud prevention, or dispute resolution.
FixFlowIQ does not routinely review every communication exchanged through the Platform.
Communications transmitted through the Platform may be processed, stored, or disclosed as described in the Privacy Policy and as otherwise permitted or required by applicable law.
Users should avoid transmitting highly sensitive personal or financial information through Platform messaging unless specifically requested through a secure process.
FixFlowIQ may send automated communications relating to Platform operations, including:
Booking confirmations.
Appointment reminders.
Payment notifications.
Verification requests.
Security alerts.
Account updates.
Customer support communications.
Legal notices.
Other administrative messages.
These communications are considered part of the operation of the Platform and may be sent electronically.
Customers and Providers are encouraged to keep communications regarding vehicle repairs, pricing, authorizations, scheduling, and warranties clear and well documented.
To the extent permitted by applicable law, communications conducted through the Platform may be retained by FixFlowIQ for legitimate business purposes, including customer support, fraud prevention, legal compliance, dispute resolution, and security.
FixFlowIQ is not responsible for statements, promises, representations, offers, warranties, negotiations, or agreements made by Customers or Providers through Platform communications.
Except as expressly stated in these Terms, communications exchanged between Users do not create obligations for FixFlowIQ.
The Platform is not intended for emergency communications.
Customers requiring immediate emergency assistance, medical assistance, law enforcement, fire services, or other emergency services should contact the appropriate emergency service provider directly.
Users should not rely on Platform messaging for time-sensitive emergency situations.
FixFlowIQ reserves the right to modify, expand, restrict, suspend, or discontinue any communication feature, messaging capability, notification service, or related functionality at any time, with or without notice, to the extent permitted by applicable law.
Nothing in this section obligates FixFlowIQ to maintain any particular communication feature or messaging service.
The Platform, including all software, source code, object code, databases, marketplace technology, artificial intelligence systems, algorithms, workflows, designs, graphics, text, photographs, videos, audio, interfaces, layouts, functionality, documentation, and all other content made available by FixFlowIQ (collectively, the "Platform Content"), are owned by or licensed to FixFlowIQ and are protected by United States and international intellectual property laws.
Except for the limited rights expressly granted in these Terms, no ownership or intellectual property rights are transferred to any User.
Without limitation, the following are the exclusive property of FixFlowIQ or its licensors, where applicable:
The FixFlowIQ name.
The FixFlowIQ logo.
FixFlowIQ branding and trade dress.
Platform design and user interface.
Marketplace architecture.
Matching technologies.
Artificial intelligence features.
Provider routing systems.
Databases and data compilations owned by FixFlowIQ.
Platform workflows.
Software code.
Business methods to the extent protected by applicable law.
Documentation.
Marketing materials.
Written content created by FixFlowIQ.
Graphics and visual designs.
Training materials.
The FixFlowIQ Verified Standards™.
Other trademarks, service marks, trade names, logos, inventions, copyrights, and proprietary materials owned or licensed by FixFlowIQ.
All rights not expressly granted in these Terms are reserved.
Subject to your compliance with these Terms, FixFlowIQ grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform solely for its intended purpose.
This license does not permit you to:
Copy the Platform.
Sell or sublicense the Platform.
Modify or create derivative works from the Platform.
Reverse engineer, decompile, or attempt to extract source code, except where prohibited by applicable law.
Remove proprietary notices.
Use Platform Content for commercial purposes without written permission.
Use automated tools to scrape or harvest Platform data except as expressly authorized.
Any rights not expressly granted are reserved by FixFlowIQ.
"FixFlowIQ," "FixFlowIQ Verified Standards™," and all associated logos, slogans, graphics, service marks, and branding are trademarks, service marks, or trade dress of FixFlowIQ or its licensors.
Users may not use, reproduce, display, register, imitate, or otherwise exploit these marks without the prior written consent of FixFlowIQ, except as expressly permitted by applicable law.
Users retain ownership of the content they submit to the Platform, including Repair Requests, photographs, videos, reviews, ratings, messages, documents, and other User Content.
By submitting User Content, you represent and warrant that you have all necessary rights to provide such content and that your submission does not violate the rights of any third party.
By submitting User Content through the Platform, you grant FixFlowIQ a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, distribute, transmit, adapt for formatting, analyze, process, and otherwise use the User Content solely for purposes including:
Operating the Platform.
Processing Repair Requests.
Facilitating Bookings.
Improving marketplace functionality.
Providing customer support.
Preventing fraud.
Maintaining security.
Conducting analytics.
Complying with legal obligations.
Promoting the Platform, where permitted by applicable law and consistent with the Privacy Policy.
This license continues for as long as reasonably necessary to operate the Platform and fulfill legitimate business and legal obligations.
If you voluntarily submit suggestions, ideas, feature requests, comments, recommendations, or other feedback regarding the Platform, you agree that FixFlowIQ may use, modify, develop, publish, commercialize, or otherwise exploit such feedback without restriction or obligation to compensate you.
Nothing in this section requires FixFlowIQ to implement any suggestion.
FixFlowIQ respects the intellectual property rights of others and expects Users to do the same.
Users may not upload, transmit, display, distribute, or otherwise make available any content that infringes copyrights, trademarks, patents, trade secrets, publicity rights, privacy rights, or other intellectual property rights of another person or entity.
FixFlowIQ reserves the right to remove allegedly infringing material and to suspend or terminate repeat infringers where appropriate.
The Platform may include third-party trademarks, logos, software, services, or other proprietary materials.
All rights in such third-party materials remain the property of their respective owners.
Nothing in these Terms grants any license or ownership rights in third-party intellectual property except as expressly stated by the applicable owner.
Except for the limited license expressly granted in these Terms, FixFlowIQ retains all right, title, and interest in and to the Platform and all associated intellectual property.
No implied licenses are granted.
Any unauthorized use of the Platform or FixFlowIQ's intellectual property may result in:
Immediate suspension or termination of your account.
Revocation of the limited license granted under these Terms.
Civil legal action.
Injunctive relief.
Monetary damages.
Recovery of attorneys' fees and costs where permitted by law.
Other remedies available under applicable law.
The provisions of this Section relating to ownership, intellectual property rights, licenses, restrictions, and remedies shall survive termination of these Terms or your use of the Platform to the extent permitted by applicable law.
You agree to use the Platform only for lawful purposes and in accordance with these Terms.
You may not use the Platform in any manner that could damage, disable, overburden, interfere with, or impair the operation, security, integrity, or availability of the Platform or interfere with another User's use of the Platform.
You may not:
Submit false or misleading information.
Create fake accounts or impersonate another person or business.
Misrepresent your identity, qualifications, licensing, insurance, or authority.
Submit fraudulent Repair Requests.
Submit fraudulent Quotes.
Use stolen payment methods.
Engage in identity theft.
Participate in payment fraud.
Attempt to deceive Customers, Providers, or FixFlowIQ.
You may not use the Platform to facilitate or promote:
Vehicle theft.
Sale or transport of stolen property.
Odometer fraud.
Title fraud.
Insurance fraud.
Tax fraud.
Emissions tampering or unlawful emissions modifications.
Illegal street racing or racing-related services prohibited by law.
Counterfeit automotive parts.
Circumvention of safety regulations.
Money laundering.
Any other unlawful activity.
FixFlowIQ reserves the right to cooperate with law enforcement authorities as permitted or required by applicable law.
You may not:
Attempt to gain unauthorized access to the Platform, servers, databases, or networks.
Circumvent security measures.
Attempt to access another User's account.
Use another person's login credentials.
Probe, scan, or test Platform vulnerabilities without authorization.
Interfere with authentication systems.
Attempt to bypass access controls or usage restrictions.
You may not:
Introduce malware, viruses, ransomware, spyware, worms, or other malicious code.
Launch denial-of-service or distributed denial-of-service attacks.
Interfere with Platform functionality.
Damage or disrupt Platform infrastructure.
Use automated tools to overload Platform systems.
Interfere with communications between Users.
Except as expressly authorized by FixFlowIQ in writing, you may not:
Scrape or harvest Platform data.
Copy Provider listings in bulk.
Copy Customer information.
Use bots or automated tools to collect information.
Build competing databases using Platform information.
Mine Platform content for commercial purposes.
Use automated scripts to access the Platform.
Nothing in this section prohibits lawful activities expressly permitted by applicable law.
You may not intentionally use the Platform to identify Customers or Providers for the purpose of avoiding applicable Booking Fees, Platform fees, or other authorized charges.
This restriction does not prohibit Customers and Providers from maintaining an independent business relationship after a lawful Booking has been completed, provided they comply with these Terms and any other applicable agreements.
You may not:
Submit fake reviews.
Purchase or sell reviews.
Coordinate review manipulation.
Threaten negative reviews to obtain discounts or refunds.
Submit reviews for transactions in which you did not participate.
Use multiple accounts to influence ratings.
You may not use Platform messaging or communication features to:
Harass Users.
Threaten Users.
Send spam.
Conduct phishing attacks.
Transmit malicious software.
Promote unlawful activity.
Distribute unsolicited commercial advertising unrelated to the Platform.
Violate another person's privacy or legal rights.
You may not:
Copy Platform software.
Reverse engineer the Platform except where prohibited by applicable law.
Remove copyright or trademark notices.
Reproduce Platform Content without authorization.
Use FixFlowIQ trademarks without permission.
Create derivative works based on the Platform except as expressly permitted.
You may not engage in conduct that interferes with the fair operation of the marketplace, including:
Manipulating search results.
Manipulating Provider rankings.
Artificially inflating ratings.
Coordinating fraudulent transactions.
Creating duplicate accounts.
Misusing promotional offers.
Attempting to interfere with automated matching systems.
Disrupting legitimate marketplace activity.
Unless expressly authorized by FixFlowIQ in writing, you may not use the Platform to:
Operate a competing marketplace using Platform information.
Resell access to the Platform.
License Platform functionality.
Commercially exploit Platform Content.
Use the Platform primarily for data mining or market research unrelated to legitimate use.
Users agree to cooperate with reasonable security measures implemented by FixFlowIQ, including identity verification, fraud prevention procedures, account verification requests, and other measures reasonably necessary to protect the Platform and its Users.
Failure to cooperate may result in restricted access or suspension of your account.
If FixFlowIQ reasonably believes that a User has violated these Terms or engaged in conduct that threatens the Platform, its Users, or the public, FixFlowIQ may, in its sole discretion and to the extent permitted by law:
Issue warnings.
Remove content.
Suspend or terminate accounts.
Restrict access to Platform features.
Remove Provider verification or Preferred Partner status.
Cancel or refuse Bookings.
Delay or decline payment processing.
Report suspected unlawful activity to appropriate authorities.
Pursue any other remedy available under these Terms or applicable law.
FixFlowIQ's decision to take or refrain from taking enforcement action in one instance does not waive its right to take action in any future instance.
The prohibited activities listed in this Section are illustrative and not exhaustive.
FixFlowIQ reserves the right to determine, in its reasonable discretion, whether conduct is inconsistent with the intended purpose of the Platform, threatens marketplace integrity, violates these Terms, or otherwise justifies corrective action.
Nothing in this Section limits any other rights or remedies available to FixFlowIQ under these Terms or applicable law.
FixFlowIQ reserves the right, in its sole discretion and to the fullest extent permitted by applicable law, to suspend, restrict, limit, or terminate your access to the Platform, your account, or any portion of the Services at any time, with or without prior notice, for any lawful reason.
Nothing in these Terms requires FixFlowIQ to continue providing access to the Platform to any particular User.
Without limiting any other rights available under these Terms or applicable law, FixFlowIQ may suspend or terminate an account if it reasonably believes that a User has:
Violated these Terms or any related Platform policy.
Submitted false, misleading, or fraudulent information.
Misrepresented identity, licensing, insurance, qualifications, or authority.
Engaged in fraud, abuse, deception, or unlawful conduct.
Violated applicable federal, state, or local laws.
Interfered with the operation, security, or integrity of the Platform.
Attempted to circumvent Booking Fees or other authorized Platform charges.
Manipulated reviews, ratings, search results, or marketplace activity.
Used the Platform in a manner that threatens other Users or the public.
Failed to maintain required licenses or insurance, where applicable.
Engaged in repeated conduct inconsistent with the FixFlowIQ Verified Standards™.
Otherwise created an unreasonable legal, financial, operational, or reputational risk to FixFlowIQ or its Users.
FixFlowIQ may temporarily suspend an account while investigating suspected violations, fraudulent activity, payment disputes, security concerns, identity verification issues, or other matters affecting the integrity or security of the Platform.
During a suspension, access to some or all Platform features may be limited or unavailable.
FixFlowIQ may immediately suspend or terminate an account without prior notice if it reasonably believes that immediate action is necessary to:
Protect the safety of Users.
Prevent fraud.
Protect Platform security.
Comply with legal obligations.
Preserve evidence.
Prevent ongoing violations of these Terms.
Protect the rights, property, or reputation of FixFlowIQ or others.
Upon suspension or termination:
Your license to access and use the Platform immediately terminates.
You must stop using the Platform unless otherwise authorized by FixFlowIQ.
Access to your account and certain account information may be restricted or disabled.
FixFlowIQ may remove or disable access to User Content where permitted by applicable law.
Pending Bookings or transactions may be canceled, modified, or otherwise handled as reasonably appropriate under the circumstances.
Termination of Platform access does not relieve any party of obligations that arose before termination.
You may close your account at any time by following the procedures made available through the Platform or by contacting FixFlowIQ.
Closing your account does not automatically:
Cancel confirmed Bookings.
Eliminate outstanding payment obligations.
Resolve disputes.
Remove reviews already published.
Eliminate obligations arising before account closure.
Require immediate deletion of records that FixFlowIQ is legally permitted or required to retain.
In addition to the rights described elsewhere in these Terms, FixFlowIQ may suspend or terminate a Provider's participation if the Provider:
No longer meets Platform eligibility requirements.
Fails to maintain required documentation.
Loses required licenses or insurance.
Fails to honor material commitments made through the Platform.
Engages in repeated customer service failures supported by credible evidence.
Violates the Preferred Partner Agreement or other Provider agreements.
Otherwise fails to meet FixFlowIQ's marketplace standards.
FixFlowIQ may also remove a Provider's Verified Provider designation or Preferred Partner status independently of account termination.
Following suspension or termination, FixFlowIQ may retain account records, communications, transaction history, payment records, verification documents, and other information as reasonably necessary for:
Legal compliance.
Fraud prevention.
Security.
Tax and accounting obligations.
Dispute resolution.
Enforcement of these Terms.
Other legitimate business purposes.
Retention of information is governed by the Privacy Policy and applicable law.
To the fullest extent permitted by applicable law, FixFlowIQ shall not be liable for any loss of profits, business opportunities, goodwill, data, reputation, or other damages arising from the lawful suspension, restriction, or termination of a User's access to the Platform.
Nothing in this section limits any rights that cannot legally be waived under applicable law.
Termination or expiration of these Terms does not affect provisions that by their nature are intended to survive, including but not limited to provisions relating to:
Intellectual Property.
Payment obligations.
Disclaimers.
Limitation of Liability.
Indemnification.
Dispute Resolution.
Governing Law.
Privacy and data retention.
Any other provision that reasonably should survive termination.
The rights described in this Section are cumulative and in addition to any other rights or remedies available to FixFlowIQ under these Terms, applicable law, or equity.
Failure by FixFlowIQ to exercise any right in a particular instance shall not constitute a waiver of that right or of any other right under these Terms.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM, INCLUDING ALL SERVICES, SOFTWARE, CONTENT, COMMUNICATION TOOLS, ARTIFICIAL INTELLIGENCE FEATURES, MATCHING TECHNOLOGY, MARKETPLACE FUNCTIONALITY, WARRANTY-RELATED DISPLAY FEATURES, BADGES, AND OTHER FEATURES PROVIDED BY FIXFLOWIQ, ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS.
FIXFLOWIQ MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, EXCEPT AS EXPRESSLY STATED IN THESE TERMS.
FixFlowIQ does not warrant that the Platform will:
Be continuously available
Operate without interruption
Be free from errors or defects
Be compatible with every device or browser
Be secure against every threat
Be free of viruses or harmful code
Meet every User's expectations
Operate without maintenance or temporary outages
Scheduled maintenance, updates, technical issues, internet failures, third-party service interruptions, cybersecurity incidents, and events beyond FixFlowIQ's reasonable control may affect Platform availability.
FixFlowIQ does not warrant, represent, or guarantee:
The qualifications of any Provider
The licensing status of any Provider at any particular time
The insurance coverage maintained by any Provider
The experience or expertise of any Provider
The quality of repairs or Services
Customer satisfaction
Future performance
Compliance with Applicable Laws by any Provider
The accuracy or completeness of Provider-submitted information
The continued eligibility of any Provider for a Platform badge, designation, or program
That any Provider will fulfill every promise, representation, discount, warranty, or other commitment made to a Customer
Providers are independent businesses solely responsible for the Services they perform and the representations they make.
FixFlowIQ does not perform automotive services and therefore does not warrant or guarantee:
Vehicle diagnoses
Repair recommendations
Repair methods
Workmanship
Parts quality
Labor quality
Completion times
Repair outcomes
Vehicle safety after repairs
Compliance of repairs with manufacturer specifications
The durability or longevity of repairs
Whether a repair will permanently correct a particular vehicle condition
Services performed under a Provider Warranty
Any warranties relating to automotive Services are solely those, if any, independently offered by the Provider performing the work.
A Provider may independently offer a Provider Warranty covering certain repairs, Services, parts, labor, or workmanship.
Unless expressly stated otherwise in a separate written agreement issued by FixFlowIQ, any such Provider Warranty is offered solely by the applicable Provider and is not a warranty issued by FixFlowIQ.
FixFlowIQ does not:
Provide or issue Provider Warranties
Act as the warrantor
Underwrite or insure Provider Warranties
Fund Provider Warranty obligations
Administer Provider Warranty programs
Determine whether a warranty claim is valid or covered
Guarantee approval of a warranty claim
Guarantee that a Provider will perform warranty repairs
Guarantee that a Provider will issue a refund, replacement, credit, or other remedy
Assume financial responsibility for a Provider's warranty obligations
The Provider remains solely responsible for complying with the terms of any Provider Warranty and all Applicable Laws governing that warranty.
The appearance of a Warranty-Backed Provider designation, Warranty Badge, warranty icon, profile label, or similar indicator on the Platform means only that the applicable Provider has represented that it offers warranty coverage and has satisfied the eligibility requirements established by FixFlowIQ for displaying that designation at the relevant time.
The Warranty-Backed Provider designation does not constitute:
A warranty issued by FixFlowIQ
Insurance provided by FixFlowIQ
A guarantee that a repair will be successful
A guarantee that a Customer's warranty claim will be approved
A guarantee that a Provider will remain financially able to satisfy warranty obligations
A certification of the quality of any particular repair
A guarantee of future Provider performance
An assumption by FixFlowIQ of the Provider's warranty obligations
FixFlowIQ may suspend, modify, restrict, or remove a Warranty-Backed Provider designation or Warranty Badge in accordance with these Terms.
Warranty Information displayed through the Platform may be submitted, supplied, or maintained by independent Providers.
Although FixFlowIQ may establish requirements regarding the submission or display of Warranty Information, FixFlowIQ does not warrant or guarantee that such information is always:
Accurate
Complete
Current
Applicable to every Service
Applicable to every part or repair
Free from exclusions or limitations
Available for every vehicle
Valid in every jurisdiction
Applicable to a particular Customer's circumstances
Customers are responsible for reviewing Provider Warranty terms before authorizing Services and should obtain clarification directly from the applicable Provider regarding coverage, exclusions, claim requirements, mileage limitations, time limits, transferability, or other warranty conditions.
FixFlowIQ does not guarantee the outcome of any Provider Warranty claim or dispute.
A Provider may determine, subject to its warranty terms and Applicable Laws, that a particular claim is excluded or otherwise not covered.
FixFlowIQ is not responsible for disagreements between Customers and Providers concerning:
Whether a repair qualifies for warranty coverage
Whether damage resulted from the original repair
Whether a part failed
Whether additional repairs are covered
Mileage or time limitations
Maintenance requirements
Customer misuse or vehicle modification
Warranty exclusions
Claim documentation
Remedies offered by the Provider
Provider refusal or failure to honor a warranty
FixFlowIQ may provide communication tools, customer support, complaint intake, or other marketplace assistance relating to such matters, but doing so does not make FixFlowIQ the warrantor, insurer, administrator, arbitrator, guarantor, or financially responsible party.
FixFlowIQ does not warrant that:
Quotes are accurate
Quotes are complete
Quotes represent final pricing
Quotes include every necessary repair
Quotes reflect actual repair costs
Quotes remain valid for any specific period
A Quote includes every condition discovered during diagnosis or repair
Quotes are prepared independently by Providers and may change following inspection, diagnosis, disassembly, discovery of additional damage, parts availability, or other circumstances.
Artificial intelligence, automated matching, recommendation systems, routing technologies, search functionality, ranking tools, and other automated Platform technologies are provided solely to assist marketplace operations.
FixFlowIQ does not warrant that AI Features will:
Produce accurate results
Identify every repair issue
Recommend the most appropriate Provider
Identify the best warranty option
Correctly interpret Provider Warranty Information
Operate without interruption
Be free from errors
Replace professional automotive judgment
Users should exercise independent judgment when using AI-generated information and should consult an appropriately qualified automotive professional when necessary.
FixFlowIQ does not verify every review, rating, photograph, Repair Request, message, document, warranty statement, claim submission, or other User Content submitted to the Platform.
Accordingly, FixFlowIQ makes no warranty regarding:
The accuracy of User Content
The completeness of User Content
The reliability of User Content
The legality of User Content
Statements made by Customers or Providers
Documents or evidence submitted in connection with a repair or warranty dispute
The Platform may integrate with or rely upon third-party services, including payment processors, mapping services, cloud providers, communication providers, analytics providers, identity verification services, and other technologies.
FixFlowIQ makes no warranty regarding the availability, performance, security, accuracy, or reliability of third-party products or services that are outside of its reasonable control.
FixFlowIQ does not guarantee:
That a Customer will receive Quotes
That a Provider will receive Repair Requests
That a Booking will occur
That a Provider will remain available
That Customers and Providers will reach an agreement
That any Warranty-Backed Provider will remain eligible for that designation
That any Provider Warranty will apply to a particular repair
That participation on the Platform will increase business or revenue
That Users will achieve any particular financial, commercial, repair, or service outcome
Marketplace participation depends on numerous factors outside FixFlowIQ's control.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIXFLOWIQ DISCLAIMS ALL IMPLIED WARRANTIES RELATING TO THE PLATFORM, INCLUDING BUT NOT LIMITED TO:
Merchantability
Fitness for a particular purpose
Title
Non-infringement
Quiet enjoyment
Course of dealing
Course of performance
Usage of trade
This disclaimer applies to FixFlowIQ and the Platform and is not intended to eliminate or modify any separate Provider Warranty or other obligation that an independent Provider is legally required to honor.
Where Applicable Laws do not permit the exclusion of certain implied warranties, such warranties are limited to the minimum extent permitted by law.
Nothing in these Terms excludes, limits, waives, or modifies any statutory warranty, consumer protection right, remedy, or other legal protection that cannot lawfully be excluded, waived, or limited under Applicable Laws.
Nothing in this Section is intended to relieve a Provider of warranty obligations, consumer protection obligations, or other legal responsibilities that Applicable Laws require the Provider to honor.
To the extent such rights apply, these Terms shall be interpreted to comply with Applicable Laws while giving maximum lawful effect to the remaining provisions.
The disclaimers contained in this Section are intended to apply to the fullest extent permitted by Applicable Laws.
If any disclaimer, exclusion, or limitation contained in this Section is determined to be unenforceable in a particular jurisdiction, the remaining provisions of these Terms shall continue in full force and effect to the maximum extent permitted by law.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIXFLOWIQ, ITS AFFILIATES, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE PLATFORM OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This limitation applies regardless of the legal theory asserted, including contract, tort (including negligence), strict liability, statute, or otherwise.
Without limitation, FixFlowIQ shall not be liable for damages relating to:
Lost profits.
Lost revenue.
Lost business opportunities.
Loss of goodwill.
Loss of reputation.
Loss of customers.
Loss of anticipated savings.
Business interruption.
Downtime.
Loss of data.
Corruption of data.
Loss of use of a vehicle.
Rental vehicle expenses.
Towing expenses.
Storage charges.
Missed appointments.
Lost wages.
Emotional distress.
Property damage caused by a Provider.
Personal injury caused by a Provider.
Repair costs.
Replacement vehicle costs.
Any other indirect, incidental, consequential, special, exemplary, or punitive damages.
Because automotive services are performed solely by independent Providers, FixFlowIQ shall not be liable for claims arising from or relating to:
Vehicle inspections.
Diagnostics.
Repair recommendations.
Workmanship.
Labor quality.
Parts supplied by Providers.
Warranty obligations.
Vehicle damage.
Delayed repairs.
Failed repairs.
Additional repairs.
Towing services.
Roadside assistance.
Body repairs.
Tire services.
Window tinting services.
Any other automotive services performed by a Provider.
Any claims relating to such services should be directed to the Provider responsible for performing the services.
FixFlowIQ shall not be liable for damages arising from:
Temporary outages.
Scheduled maintenance.
Internet failures.

Unauthorized access.

Events beyond FixFlowIQ's reasonable control.
FixFlowIQ shall not be liable for the acts, omissions, statements, representations, negligence, misconduct, fraud, unlawful conduct, or other actions of Customers, Providers, or other third parties using the Platform.
FixFlowIQ shall not be liable for damages arising from or relating to third-party products or services, including:
Payment processors.
Mapping and navigation services.
Cloud hosting providers.
Identity verification services.
Communication providers.
Analytics providers.
Artificial intelligence providers.
Other third-party technologies integrated with the Platform.
Third-party products and services are governed by the terms and policies of their respective providers.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF FIXFLOWIQ ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF:
THE TOTAL BOOKING FEES PAID BY YOU TO FIXFLOWIQ DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
ONE HUNDRED U.S. DOLLARS (US $100.00).
This limitation applies regardless of the number of claims asserted.
You acknowledge and agree that:
The limitations of liability contained in these Terms are an essential basis of the agreement between you and FixFlowIQ.
The pricing of Platform services reflects these limitations.
FixFlowIQ would not be able to provide the Platform on the same economic terms without these limitations.
Some jurisdictions do not permit the exclusion or limitation of certain damages or liabilities.
Where applicable law prohibits a particular limitation, that limitation shall apply only to the minimum extent permitted by law, and all remaining provisions of this Section shall remain in full force and effect.
Nothing in these Terms limits or excludes liability for:
Fraud or fraudulent misrepresentation by FixFlowIQ.
Willful misconduct by FixFlowIQ where liability cannot legally be limited.
Death or personal injury caused by FixFlowIQ's own negligence where such limitation is prohibited by applicable law.
Any liability that cannot lawfully be excluded or limited under applicable law.
The limitations of liability contained in this Section survive the suspension, termination, or expiration of these Terms and continue to apply to all claims arising out of or relating to the Platform or these Terms, to the fullest extent permitted by applicable law.
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless FixFlowIQ LLC, its affiliates, subsidiaries, parent entities, officers, directors, members, managers, employees, agents, contractors, licensors, successors, assigns, and representatives (collectively, the "FixFlowIQ Parties") from and against any and all claims, demands, actions, proceedings, investigations, liabilities, judgments, damages, losses, costs, expenses, fines, penalties, and reasonable attorneys' fees arising out of or relating to:
Your access to or use of the Platform.
Your violation of these Terms.
Your violation of applicable law.
Your User Content.
Your communications with other Users.
Your negligence, misconduct, fraud, or willful acts or omissions.
Your infringement or alleged infringement of any intellectual property or other legal rights of another person or entity.
Your breach of any representation, warranty, or obligation under these Terms.
If you use the Platform as a Customer, you additionally agree to indemnify the FixFlowIQ Parties against claims arising from or relating to:
Information submitted in a Repair Request.
Authorization of automotive services.
Ownership or authorized use of a vehicle.
Payment disputes with a Provider.
Vehicle condition or safety issues not caused by FixFlowIQ.
Disputes concerning repairs, pricing, warranties, or services performed by an independent Provider.
Your violation of agreements made directly with a Provider.
If you use the Platform as a Provider, you additionally agree to indemnify the FixFlowIQ Parties against claims arising from or relating to:
Automotive services you perform.
Diagnostics, inspections, or repair recommendations.
Labor, workmanship, or parts.
Warranties you provide.
Pricing or Quotes you submit.
Licensing or insurance issues.
Employment-related claims involving your employees or contractors.
Tax obligations.
Workplace injuries.
Property damage.
Personal injury.
Violations of consumer protection laws.
Environmental compliance.
Failure to comply with applicable laws or regulations.
Breach of the Preferred Partner Agreement or other Provider agreements.
FixFlowIQ reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
If FixFlowIQ elects to do so, you agree to cooperate fully and provide all reasonable assistance in the defense of such matter.
Nothing in this Section limits your indemnification obligations.
You may not settle any claim subject to this Section if the settlement:
Imposes any obligation on a FixFlowIQ Party.
Requires an admission of fault by a FixFlowIQ Party.
Restricts the rights of a FixFlowIQ Party.
Grants non-monetary relief affecting a FixFlowIQ Party.
Unless FixFlowIQ provides prior written consent, which shall not be unreasonably withheld, conditioned, or delayed.
Your indemnification obligations under these Terms are independent of, and not limited by, any insurance coverage you may maintain.
The existence of insurance does not reduce or eliminate your obligations under this Section.
The indemnification obligations contained in this Section continue after:
Account suspension.
Account termination.
Deletion of your account.
Completion of a Booking.
Expiration or termination of these Terms.
To the extent claims relate to events that occurred while these Terms were in effect.
The obligations contained in this Section apply only to the fullest extent permitted by applicable law.
Nothing in this Section requires indemnification for claims arising solely from the gross negligence, willful misconduct, or fraud of a FixFlowIQ Party where such indemnification would be prohibited by applicable law.
This Section survives the suspension, termination, expiration, or completion of your use of the Platform and remains enforceable to the fullest extent permitted by applicable law.
FixFlowIQ encourages Customers, Providers, and other Users to resolve disputes promptly and in good faith.
Before initiating formal legal proceedings relating to these Terms or the Platform, the parties agree to make a reasonable effort to resolve the dispute through informal discussions.
A party seeking to raise a dispute should provide written notice describing:
The nature of the dispute.
The relevant facts.
The requested resolution.
Supporting documentation, if available.
The parties agree to make reasonable efforts to resolve the matter within thirty (30) days after receipt of such notice before pursuing additional legal remedies, unless immediate relief is reasonably necessary.
Disputes relating to automotive services are generally the responsibility of the Customer and the Provider.
Such disputes may include, but are not limited to:
Repair quality.
Workmanship.
Parts.
Pricing.
Warranties.
Completion times.
Property damage.
Personal injury.
Payment for automotive services.
Service recommendations.
FixFlowIQ is not a party to the agreement for automotive services between a Customer and a Provider and is not obligated to investigate, mediate, arbitrate, or resolve disputes between them.
At its sole discretion, FixFlowIQ may provide communication tools or facilitate discussions in an effort to help Users communicate more effectively.
If a dispute relates directly to the operation of the Platform or services provided by FixFlowIQ, Users are encouraged to contact FixFlowIQ before initiating formal legal proceedings.
FixFlowIQ may review the matter, request additional information, and attempt to resolve the issue in good faith.
Nothing in this Section obligates FixFlowIQ to provide a particular outcome or resolution.
Where permitted by applicable law and if mutually agreed by the parties after a dispute arises, disputes relating directly to these Terms or the Platform may be resolved through binding arbitration instead of litigation.
Unless otherwise agreed:
Arbitration shall be conducted by a mutually agreed arbitration provider.
The arbitration shall take place in North Carolina, unless another location is agreed upon by the parties or required by applicable law.
The arbitration shall be conducted in the English language.
The arbitrator shall have authority to award any remedy available under applicable law, subject to these Terms.
Nothing in this Section requires either party to agree to arbitration after a dispute arises unless a separate written agreement provides otherwise.
Nothing in these Terms prevents either party from bringing an eligible claim in a court of competent small claims jurisdiction, provided the claim qualifies under applicable law and the matter remains within that court's jurisdictional limits.
Nothing in these Terms prevents FixFlowIQ from seeking temporary, preliminary, or permanent injunctive or equitable relief where reasonably necessary to:
Protect intellectual property.
Protect confidential information.
Prevent unauthorized access.
Protect Platform security.
Prevent fraud.
Enforce restrictions relating to misuse of the Platform.
Prevent irreparable harm.
Such relief may be sought in any court of competent jurisdiction.
To the fullest extent permitted by applicable law, any claim arising out of or relating to these Terms or the Platform must be commenced within one (1) year after the claim first arose or reasonably should have been discovered.
This limitation does not apply where a longer limitation period is required by applicable law.
In any legal proceeding arising out of or relating to these Terms, the prevailing party shall be entitled to recover its reasonable attorneys' fees, court costs, and other recoverable litigation expenses to the extent permitted by applicable law and ordered by the applicable court or arbitrator.
If any provision of this Section is determined by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by applicable law.
Any invalid provision shall be interpreted, reformed, or limited only to the extent necessary to make it enforceable while preserving its original intent as closely as possible.
Unless prohibited by applicable law or impossible under the circumstances, the parties agree to continue performing their respective obligations under these Terms while a dispute is being resolved.
Nothing in this Section limits any legal rights, remedies, defenses, or causes of action that cannot lawfully be waived under applicable law.
Except as expressly stated in these Terms, each party retains all rights and remedies available under applicable law.
These Terms, your access to and use of the Platform, and any dispute arising out of or relating to these Terms or the Platform shall be governed by and construed in accordance with the laws of the State of North Carolina and the applicable federal laws of the United States, without regard to its conflict of law principles.
Unless otherwise required by applicable law or expressly agreed by the parties in writing, any legal action or proceeding arising out of or relating to these Terms or the Platform shall be brought exclusively in the state or federal courts located in the State of North Carolina.
Each party irrevocably submits to the personal jurisdiction of such courts for the purpose of resolving disputes arising under these Terms.
The parties agree that North Carolina is a reasonable and convenient venue for resolving disputes relating to the Platform and waive, to the fullest extent permitted by applicable law, any objection based on improper venue or forum non conveniens.
Nothing in these Terms authorizes conduct that would violate applicable law.
Users are solely responsible for ensuring that their use of the Platform complies with all applicable federal, state, local, and international laws, regulations, licensing requirements, court orders, and governmental rules applicable to their activities.
The Platform is operated from the United States.
Users who access the Platform from outside the United States do so voluntarily and are responsible for complying with the laws of the jurisdictions from which they access or use the Platform.
FixFlowIQ makes no representation that the Platform or its content is appropriate or available for use in every country or jurisdiction.
FixFlowIQ may comply with valid subpoenas, court orders, search warrants, governmental requests, or other legal process to the extent required or permitted by applicable law.
Nothing in these Terms limits FixFlowIQ's ability to cooperate with law enforcement or governmental authorities where legally authorized or required.
Users agree not to use, export, re-export, transfer, or otherwise make available the Platform or any related software or technology in violation of applicable United States export control laws, economic sanctions, or other applicable trade regulations.
Users represent that they are not located in, organized under the laws of, or ordinarily resident in any jurisdiction subject to comprehensive sanctions that would prohibit such access under applicable law, and that they are not prohibited from using the Platform under applicable export or sanctions laws.
Nothing in these Terms is intended to limit or waive any consumer protection rights, statutory rights, or other legal protections that cannot lawfully be excluded or limited under applicable law.
Where a mandatory law grants additional rights or requires a different legal outcome, those rights shall prevail only to the extent required by law, and the remaining provisions of these Terms shall continue in full force and effect.
If any provision of this Section or these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law.
The remaining provisions shall remain valid, enforceable, and in full force and effect.
Nothing in this Section limits FixFlowIQ's right to seek any legal or equitable remedy available under applicable law, including temporary, preliminary, or permanent injunctive relief where appropriate.
The rights and remedies provided in these Terms are cumulative and in addition to any rights or remedies available under applicable law.
By accessing or using the Platform, creating an account, submitting a Repair Request, applying as a Provider, making a Booking, or otherwise interacting with FixFlowIQ electronically, you consent to receive communications from FixFlowIQ in electronic form.
Electronic communications may include:
Account notifications.
Booking confirmations.
Appointment reminders.
Payment receipts.
Security alerts.
Verification requests.
Customer support responses.
Updates to these Terms.
Privacy Policy updates.
Service announcements.
Legal notices.
Other communications relating to your use of the Platform.
You agree that such electronic communications satisfy any legal requirement that communications be provided in writing, except where applicable law requires otherwise.
FixFlowIQ may communicate with you through one or more of the following methods:
Email.
In-app notifications.
Text messages (SMS), where you have provided a telephone number and consent where required by law.
Push notifications.
Platform messaging.
Notices posted on the Platform.
Other electronic communication methods made available through the Platform.
You are responsible for maintaining accurate and current contact information in your account.
You agree that your use of electronic signatures, checkboxes, buttons, digital acknowledgments, electronic submissions, or similar electronic actions through the Platform constitutes your legally binding electronic signature.
Actions such as selecting "I Agree," "Accept," "Submit," "Continue," "Book Now," "Create Account," or similar confirmations indicate your intent to be legally bound by the applicable agreement.
To the fullest extent permitted by applicable law, electronic signatures shall have the same legal effect as handwritten signatures.
You consent to the creation, storage, transmission, and retention of electronic records relating to your use of the Platform.
Electronic records may include:
Account registration information.
Repair Requests.
Quotes.
Booking confirmations.
Payment records.
Communications.
Provider applications.
Verification records.
Agreements.

Other records relating to Platform activities.
FixFlowIQ may retain such records in accordance with its Privacy Policy, legal obligations, and legitimate business needs.
You are responsible for ensuring that your email address, telephone number, mailing address (if applicable), and other contact information remain accurate and current.
FixFlowIQ is not responsible for missed communications resulting from inaccurate, outdated, or incomplete contact information provided by you.
Except where a different method is required by applicable law, FixFlowIQ may provide legal notices electronically.
Legal notices are deemed received:
When sent to the email address associated with your account.
When delivered through the Platform.
When posted within your account.
When otherwise transmitted through an electronic communication method authorized under these Terms.
You are responsible for regularly reviewing communications associated with your account.
You are encouraged to retain copies of these Terms, the Privacy Policy, Booking confirmations, receipts, and other important communications for your records.
Where available, copies may be accessed through your account or requested from FixFlowIQ.
Nothing in these Terms limits any legal obligation requiring FixFlowIQ to provide notices in a particular format or manner.
Where applicable law requires paper notices or another specific delivery method, FixFlowIQ will comply with such requirements.
FixFlowIQ reserves the right to modify its methods of communication, notification systems, electronic signature processes, and recordkeeping practices as technology evolves or as required by applicable law.
Any material changes will be implemented in accordance with these Terms and applicable legal requirements.
The Platform may integrate with, rely upon, or provide access to products, services, software, websites, applications, application programming interfaces (APIs), payment processors, mapping services, communication providers, identity verification services, cloud hosting providers, artificial intelligence technologies, analytics providers, and other third-party services (collectively, "Third-Party Services").
These Third-Party Services are provided for convenience and to enhance the functionality of the Platform.
Third-Party Services are owned, operated, and controlled by their respective providers.
Except as expressly stated otherwise, FixFlowIQ does not own, operate, supervise, or control Third-Party Services and is not responsible for their actions, omissions, availability, security, accuracy, performance, or business practices.
Your use of Third-Party Services may be subject to separate terms of service, privacy policies, licensing agreements, or other legal terms established by the applicable third-party provider.
You are responsible for reviewing and complying with those terms when using Third-Party Services.
Nothing in these Terms modifies or replaces the contractual relationship between you and any third-party provider.
Payments processed through the Platform may be handled by independent third-party payment processors.
FixFlowIQ is not responsible for:
Banking services.
Credit or debit card processing.
Financial institution decisions.
Payment processor outages.
Delays in payment processing.
Fraud prevention decisions made by payment processors.
Card issuer approvals or denials.
Payment processing remains subject to the applicable payment processor's terms and policies.

FixFlowIQ does not guarantee the accuracy, completeness, availability, or reliability of mapping information, directions, estimated travel times, addresses, or geographic data supplied by third-party services.

FixFlowIQ does not guarantee the availability, accuracy, completeness, or uninterrupted operation of any third-party artificial intelligence service.

The inclusion of a link does not constitute:

A waiver of one breach shall not constitute a waiver of any subsequent or different breach.
You may not assign, transfer, delegate, or otherwise convey your rights or obligations under these Terms without the prior written consent of FixFlowIQ.

FixFlowIQ shall not be liable for any delay, interruption, failure to perform, or inability to provide the Platform resulting from causes beyond its reasonable control, including but not limited to:

Severe weather.
Floods.
Fires.
Earthquakes.
Pandemics.
Epidemics.
Public health emergencies.
Acts of government.
War.
Terrorism.
Civil unrest.
Labor disputes.
Utility failures.
Internet outages.
Telecommunications failures.

Supply chain disruptions.
Failures of third-party service providers.
Other events beyond FixFlowIQ's reasonable control.
Nothing contained in these Terms shall be construed to create an employment, agency, partnership, joint venture, franchise, fiduciary, or contractor relationship between:

FixFlowIQ and any Provider.
Customers and FixFlowIQ.
Providers and FixFlowIQ.
FixFlowIQ operates solely as an independent technology marketplace unless expressly stated otherwise in a separate written agreement.
Section titles and headings are included solely for convenience and shall not affect the interpretation of these Terms.
Words such as "including," "includes," and "include" shall be interpreted to mean "including without limitation."
The singular includes the plural where appropriate, and the plural includes the singular.
References to one gender include all genders.
Except as expressly provided in these Terms, these Terms are intended solely for the benefit of the parties.
No person or entity that is not a party to these Terms shall have any right to enforce any provision of these Terms as a third-party beneficiary.
Any provisions that by their nature should survive the termination or expiration of these Terms shall remain in full force and effect, including, without limitation:
Payment obligations.
Intellectual Property Rights.
Disclaimers.
Limitation of Liability.
Indemnification.
Dispute Resolution.
Governing Law.
Privacy obligations.
Record retention.
Any other provision intended to survive.
